You're right Frank...and wrong,

While there is nothing on the tape to sustain a charge of burglary there is PLENTY for a ROBBERY charge.

No there isn't. Not on the tape.

OK frank he spelled it wrong...but you know exactly waht he's talking about.
His behavoir (you can figure out that mispelled word right?) was indicitve of someone with a wanton disregard and cavalier attitude toward any authority, convention or social mores...that and the weed got him killed.

You do not know that from the tape either.

The guy being pushed (you cannot tell it is the owner from the tape)...could simply be saying something to the guy using the "N" word...like some of the people here in A2K have been doing.

The tape tells you nothing.

@Frank Apisa,
Frank...the guy who tried to block his exit was identified as a store employee. Taking a $50 Box of cigars by force or threat of force is ROBBERY. You can see he didnt pay for the cigars and you can see him use force and threaten the use of force...I suppose if we had seen him hit the guy and they fought, you'd argue that it could have been a a mutually agreed to boxing exhibition.
You argue for the sake of arguement, sans any logic.

I have repeatedly said "from the tape." There were no captions. You would need people telling who was who...and what was happening.

Yes, but some stories, including one told by the store owner, was that a purchase occurred...and that there was a dispute over how many were bought and how many were allegedly stolen. We cannot tell that from the tape. We have got to wait until the Grand Jury decides what went down. And then may have to wait for a jury to decide what happened.

Jesus H. Christ, John...YOU CANNOT SEE THAT AT ALL. What kind of "cop" were you...a crossing guard?

I have no idea of what caused that altercation...and neither do you. I am open-minded and reasonable enough to say wait until the Grand Jury tells us their opinion...and you are not.

Frank:

Did you see the WHOLE TAPE???? I did. It shows him taking the box of cigars from the dispaly and then and it shows him LEAVING THE STORE WITHOUT PAYING.
There was no dispute about how many were bought and how many were stolen...where are you getting this fairy tale from????
Even if this is correct...the operative word heRE is STOLEN...IT'S STILL A STRONG ARM ROBBERY.

I think you are just winging it here, John...and rather poorly at that.

Please provide a link to a tape that conclusively shows Brown stealing cigars.

YOU CANNOT DO IT.

And please answer my question: What kind of cop were you...a crossing guard?

Yeah, well...John has pretty much insulted himself by speaking as a cop...and claiming the things he did about that video.

The video does not show anything of probative value...in and of itself...which is all I was saying.

He was ERRONEOUSLY insisting otherwise.

But it was an insult...

...and John...I apologize. I should be above that kind of thing.

@Frank Apisa,
Frank: Let me put this to bed right now...#1 Dorian Johnson testified to police and the FBI the Brown stole the cigars. The store employees made a statement to police saying Brown stole the cigars.
#2 Even if Brown only stole 1/2 the ******* cigars...IT'S STILL A FELONY, to wit: ROBBERY. It's like being slightly pregnant Frank...NO SUCH THING.
If you want to watch the video...you find it. I've seen it. It was all over the news.
You argue a point based on specious logic...apparently for the sake of arguing.
Yes anything is possible Frank...maybe the guy that was on the video was really a ******* alien in a Micahel Brown suit and really needed the cigars to refuel his warp engines...but I really dont think so Frank. Drunk

@Frank Apisa,
I dunno what U saw,
but I saw a video with decedent
running away with some property
after knocking a little fellow around inside that little store,
that we later found out was the cigar store n its proprietor.
I think the missing cigars were later found in decedent's possession,
but correct me if I am rong.

You cannot tell there was a robbery from the video, John. That is all I have said...and apparently you are unable to work up the courage to simply acknowledge that I am correct.

No problem.

I will stick with what I said earlier.

You CANNOT tell a robbery occurred just from the video.

It wouda been FUN
if, to his SURPRIZE, when decedent entered the victim cigar store,
he found its proprietors to be as much bigger than he was
by the same ratio as his overbearing the little cigarstore owner whom he knocked around;
(either that, or if the owner had shot the robber).

I get a good laff from it, when the victim overpowers the predator!

I don t think that u join me in that sentiment, Frank.

Frank: I wish to hell I had that type of evidence on any other strong arm robbery I ever had to prosecute...video showing the unlawful taking by force of property not his own...SLAM DUNK IN ANY COURT. (except in the court of FRANK)

Actually, David...I do. I get a terrific laugh whenever a smaller person is able to handle a larger person who is an aggressor.

But that is not what was being discussed.

So now you are claiming to be a prosecutor also???

If the tape were the only evidence...and all I am talking about is the tape...there is not a competent prosecutor in the country who would take this on.

But since you cannot acknowledge that...you can continue with your fantasy.
