Legal fight over red cross symbol

Medical firm Johnson & Johnson (J&J) is suing the American Red Cross, alleging the charity has misused the famous red cross symbol for commercial purposes.

J&J said a deal with the charity's founder in 1895 gave it the "exclusive use" of the symbol as a trademark for drug, chemical and surgical products.

It said American Red Cross had violated this agreement by licensing the symbol to other firms to sell certain goods.

The charity described the lawsuit as "obscene".

It said many of the products at issue were health and safety kits and that profits from their sale had been used to support disaster-relief campaigns.

Licence dispute

The lawsuit asks for sales of disputed products - also including medical gloves, nail clippers, combs and toothbrushes - to be stopped and unsold items to be handed over to J&J.

The firm is also seeking damages equivalent to the value of such goods sold in supermarkets such as Wal-Mart and Target.

"After more than a century of strong co-operation in the use of the Red Cross trademark... we were very disappointed to find that the American Red Cross started a campaign to license the trademark to several businesses for commercial purposes," the firm said in a statement.

J&J, best known for its Band-Aid bandages and baby products, first used the symbol as a trademark in 1887, the same year it was incorporated as a business.

American Red Cross was founded in 1881 but did not receive a charter from the US Congress until 1900.


The lawsuit argues that the firm reached an agreement with the charity's founder Clara Barton about the commercial use of the symbol for certain products.

It maintains that the charter did not give the charity the right to engage in commercial activities which would conflict with a private company.

The two sides have been trying to resolve the dispute in private for several months and the lawsuit will bring unwelcome publicity for both parties.

'Sound case'

American Red Cross said allegations that it broke criminal statutes were "obscene", adding that it believed the firm's actions were financially motivated.

"Our outside lawyers have looked at this and think we are on sound ground," said Mark Everson, the charity's chief executive.

"We are helping Americans."

The red cross symbol was adopted by the forerunners to the International Committee of the Red Cross in 1863.

The symbol was chosen to denote respect for army medical services, first aid volunteers and victims of wars and armed conflicts around the world.

"At its annual assembly, the Evangelical Lutheran Church in America (ELCA) passed by a vote of 538-431 a resolution urging bishops to refrain from disciplining pastors who are in “faithful committed same-gender relationships”."

Here is what the Bible says about qualification to be a church leader under the new covenant:

1 Timothy 1-3, “Paul, an apostle of Christ Jesus according to the command of God our Savior and of Christ Jesus, our hope:

To Timothy, my true child in the faith.

Grace, mercy, and peace from God the Father and Christ Jesus our Lord.

As I urged you when I went to Macedonia, remain in Ephesus so that you may command certain people not to teach other doctrine or to pay attention to myths and endless genealogies. These promote empty speculations rather than God's plan, which operates by faith. Now the goal of our instruction is love from a pure heart, a good conscience, and a sincere faith. Some have deviated from these and turned aside to fruitless discussion. They want to be teachers of the law, although they don't understand what they are saying or what they are insisting on. Now we know that the law is good, provided one uses it legitimately. We know that the law is not meant for a righteous person, but for the lawless and rebellious, for the ungodly and sinful, for the unholy and irreverent, for those who kill their fathers and mothers, for murderers, for the sexually immoral and homosexuals, for kidnappers, liars, perjurers, and for whatever else is contrary to the sound teaching based on the glorious gospel of the blessed God that was entrusted to me.


I give thanks to Christ Jesus our Lord, who has strengthened me, because He considered me faithful, appointing me to the ministry—one who was formerly a blasphemer, a persecutor, and an arrogant man. Since it was out of ignorance that I had acted in unbelief, I received mercy, and the grace of our Lord overflowed, along with the faith and love that are in Christ Jesus. This saying is trustworthy and deserving of full acceptance: "Christ Jesus came into the world to save sinners"—and I am the worst of them. But I received mercy because of this, so that in me, the worst [of them], Christ Jesus might demonstrate the utmost patience as an example to those who would believe in Him for eternal life. Now to the King eternal, immortal, invisible, the only God, be honor and glory forever and ever. Amen.

Timothy, my child, I am giving you this instruction in keeping with the prophecies previously made about you, so that by them you may strongly engage in battle, having faith and a good conscience. Some have rejected these and have suffered the shipwreck of their faith. Hymenaeus and Alexander are among them, and I have delivered them to Satan, so that they may be taught not to blaspheme.

First of all, then, I urge that petitions, prayers, intercessions, and thanksgivings be made for everyone, for kings and all those who are in authority, so that we may lead a tranquil and quiet life in all godliness and dignity. This is good, and it pleases God our Savior, who wants everyone to be saved and to come to the knowledge of the truth.

For there is one God and one mediator between God and man, a man, Christ Jesus, who gave Himself—a ransom for all, a testimony at the proper time.

For this I was appointed a herald, an apostle (I am telling the truth; I am not lying), and a teacher of the Gentiles in faith and truth.

Therefore I want the men in every place to pray, lifting up holy hands without anger or argument. Also, the women are to dress themselves in modest clothing, with decency and good sense; not with elaborate hairstyles, gold, pearls, or expensive apparel, but with good works, as is proper for women who affirm that they worship God. A woman should learn in silence with full submission. I do not allow a woman to teach or to have authority over a man; instead, she is to be silent. For Adam was created first, then Eve. And Adam was not deceived, but the woman was deceived and transgressed. But she will be saved through childbearing, if she continues in faith, love, and holiness, with good sense.

This saying is trustworthy: "If anyone aspires to be an overseer, he desires a noble work." An overseer, therefore, must be above reproach, the husband of one wife, self-controlled, sensible, respectable, hospitable, an able teacher, not addicted to wine, not a bully but gentle, not quarrelsome, not greedy—one who manages his own household competently, having his children under control with all dignity. (If anyone does not know how to manage his own household, how will he take care of God's church?) He must not be a new convert, or he might become conceited and fall into the condemnation of the Devil. Furthermore, he must have a good reputation among outsiders, so that he does not fall into disgrace and the Devil's trap.

Deacons, likewise, should be worthy of respect, not hypocritical, not drinking a lot of wine, not greedy for money, holding the mystery of the faith with a clear conscience. And they must also be tested first; if they prove blameless, then they can serve as deacons. Wives, too, must be worthy of respect, not slanderers, self-controlled, faithful in everything. Deacons must be husbands of one wife, managing their children and their own households competently. For those who have served well as deacons acquire a good standing for themselves, and great boldness in the faith that is in Christ Jesus.

I write these things to you, hoping to come to you soon. But if I should be delayed, [I have written] so that you will know how people ought to act in God's household, which is the church of the living God, the pillar and foundation of the truth. And most certainly, the mystery of godliness is great:

He was manifested in the flesh, justified in the Spirit, seen by angels, preached among the Gentiles, believed on in the world, taken up in glory.”

Active gays can't serve as clergy. If they abstain and lead faithfully celibate lives, okay. Biblical strictures against homosexuality are simply too numerous and condemnatory for exceptions to be made here. Sorry. No one can have everything he wants. That's life.

Once again, that may be Pinochet's reality...but fortunately for the rest of us, you don't get to call the shots...The Episcopal Church has gay clergy, as do other denominations....whether or not they are celibate is another topic.
There is debate whether or not the Bible speaks to homosexuality.

There are many Biblical passages in which homosexual acts are condemned. An actively gay clergy constitutes a direct contradiction of Biblical teaching. It makes no sense. Gays can't help what they are, but they should remain celibate.

Talk about judgmental. The difference is you are judging that God's Word is wrong. I pity you for this mis-judgment.

On the contrary...God gave most of us brains, and He expects us to make use of them. I choose to use my brain, and my intellect, and my ability to reason...and doing so, has led me to the conclusion, that everything in the bible "Ain't Necessarily So", to coin the song from Porgy and Bess.
God didn't sit down at his little cosmic typewriter and wrote the bible, word for word.....I believe some of the figures in the Bible "were" divinely inspired, however they were messengers...human messengers, and humans, invariably get things "wrong". I would, therefore, pick and choose, and ponder and reason, and interpret with my brain what is written in the Bible, and examine my heart and my head for the answers. That is logic and reason...and how "I" choose to live my life....Don't pity me....save it for yourself.
You are free to believe as you do...but you have no right telling me what to believe or that I'm wrong for believing as I do. Who are YOU?

I'm the guy who wrote the post. I'm a guy who read the Bible more than once in more than one translation for himself instead of taking the word of people or religious leaders who have their own agendas.

I'm not telling you what to believe. I'm telling you what I read. If you choose to ignore, then ignore. As those who choose to corrupt our society are fond of saying nothing is forcing you to engage or even to read what I write. You are the person who entered this conversation with vituperation and continues with disdain.

Good ideas rise on their own merits. Bad ideas die. God's Word is eternal and lives regardless of what man does to outlaw It because It is inconvenient to a man's lifestyle choice. You can't do anything about that, even if you lable It (God's Word) as hate and outlaw people's ability to express it. You can't do anything about it even if you intimidate Christians into silence by coersion. God is not silent. He and His Word speak everyday.
