Racist Algorithms, Crime, And The Ethical Use Of Data Prediction In The Criminal Justice System

"ProPublica came out with an excellent piece this week by Julia Angwin, Jeff Larson, Surya Mattu and Lauren Kircher looking at the algorithms used by the US justice system to predict the recidivism rate of people at different stages within the justice system. These predictive scores, called risk assessment scores, are then used to determine things like sentencing and bail amounts, with those who have a high probability of committing future crimes getting higher sentences than those with lower scores. Low and behold, these scores are also correlated with race, so if a black man and white man commit the same crime, the black man is more likely to have a higher risk assessment score which could result in a tougher prison sentence or a higher bail.

As someone who builds predictive models for a living, I am dismayed at the misuse of predictive algorithms for the purposes of discrimination, though I don’t think it’s the algorithm itself that is the problem, or at least not for the reasons that others seem to think.

Why do some predictive models give racist results?

In 2016 in the United States we are living under a white supremacist society where black men and women face institutionalized racism that leads to less opportunities for jobs and credit and greater risk of arrest and violence. Because of institutionalized racism, there are many undesirable things that correlate with being black, such as lower income, likelihood of participating in certain types of crimes, increased likelihood of being arrested for said crimes, and increased recidivism rates for those who have served their term and are released from jail. This is a classic case of causation does not equal correlation. Being black is correlated with these things not because there is something innate about black people that causes them to commit crimes but because we live in a society where external hardships are imposed on black people because they are black and those hardships themselves are correlated with crime.

The problem with the actual risk assessment model that ProPublica looked into, created by the company Northpointe, isn’t just that it gives higher scores to people who are black. In fact, the model overestimates the recidivism rate of black individuals and underestimates it for white individuals. The model results don’t match reality in ways that really are racist against black people.

Ferguson city attorney steps down after criticism

The city attorney for Ferguson, Missouri, who was criticized in a U.S. Justice Department report on policing in the town, said on Tuesday she is stepping down.

Stephanie Karr, who had also served as city prosecutor until recently, said the decision to resign was hers alone, in a letter dated on May 23 that she provided to Reuters by email.

Ferguson will start looking for a new city attorney next week, the city said in a statement. The city contracts for legal services, so it will issue a request for proposals on June 1.

Ferguson became an international symbol of problems with race and policing in the United States when it was rocked by protests and riots in 2014 after white police officer Darren Wilson shot and killed black teenager Michael Brown, and after a grand jury decided not bring charges against Wilson.

How did this happen?

The “tough on crime” punishment philosophy of the 1980's and 90's, combined with a heinous “War on Drugs,” led to legislation under Republican and Democratic administrations that used a jail cell as a first, rather than last, resort for people who broke the law.

This uncompromising posture, which often exploited racial fear, became an essential part of running a political campaign. For years, elected officials competed with one another on how brutally they would be willing to punish people who broke the law, especially regarding drug-code violations. Legislators enacted policies that led to more people being locked away for increasingly smaller offenses, and combined them with further policies that kept people locked up longer.

The prison population skyrocketed.

Downs, 41, and Allison, 55, were unaware they were being recorded when they made the racially charged comments about Martin while they were on duty, the Logan Daily News reported.

Allison said: 'That n****r is a good n****r, Lord.

'Wasn’t that n****r wearing a hoodie in Florida? It was like 90 degrees,' he also said.

He added: 'We could make a little money if they all pay us to burn crosses in n****r yards. We could sell portable crosses like a wood cross with a base so you could just stand it in the yard instead of like having to dig a hole for it. it could have the fire starter chunks built in it.'

The Ku Klux Klan has previously burned crosses to intimidate black people.
When asked if Zimmerman was right to shoot Martin and if gun control played a part in the shooting, Downs said: 'It did, but a lot of it was because he was a n****r – a n****r thug.'
During the conversation, he was also heard to say 'maybe you shouldn’t be black' and 'I’d say, a dead one, you know it'.
Describing a black person, he said: 'All you can see are two white things - eyeballs and teeth.'


Downs remains with the sheriff's office and has worked in law enforcement for more than 20 years.
Allison left the force in 2014 after 26 years working there. He returned last year but resigned again after the recording was revealed.

Pfft, Sanders will do just like Trump has done if running in the general election...take money from wherever he can get it....Trump ran on the idea he isnt "bought", but now hes holding fundraisers...you think Bernie wont do the same? Its the American way baby! Get used to it! I dont bother with promises they cant back up, I prefer experience. A person running for president should at least have an idea od what they will be facing....and Trump has already admitted he wont bother with the Presidential stuff he doesnt like. He said he will make others do it. How long in the real world does that last before they are fired? I sure hope Trump picks a damn good VP, cuz if he wins, its his 2nd that will run the country. Maybe for the first time in recent history, Dems and GOP will agree on something. Trump has got to go!

Sanders is lost cause. Continue to support his whining and unacceptance of that, and Trump will surely win! This is where you and I disagree my friend. I get that he has grand promises for this country...but they are unrealistic...especially with a GOP controlled congress. He could never handle that. We complain all the time the GOP wont compromise, they are too idealistic. Well so is Sanders...... For instance....Obama announced his choice for SUpreme Court...hes a moderate...and when Sanders was asked about him, Sanders respinse was, (paraphrase)" hes not as progressive as I would like." Its total tone deafness of the congress we are dealing with right now. I dont like the "tea party" ideology because its too extreme...and I think its fair to not like the super left progressives as well as too extreme. We are a country built on compromise and I dont see Sanders as the man to get it done.

Clinton...I dismiss the conspiracies around her, they have no basis. She has true experience. She was the wife of a president for 8 years. She knows how hard it is. She was a senator, she was Secretary of State! Whats not to respect in that. The only thing I am disappointed in her is ....she voted FOR the Iraq war which I was against from the get go. Other then that, she has the toughness to handle the job, and the worldwide respect of other nations. Shes our best choice.

TALLAHASSEE, Fla. (AP) — The white police officer who handcuffed a black woman outside a Florida hospital where she died less than two hours later will not face charges.

Glenn Hess, state attorney for Florida's 14th Judicial Circuit, has completed his review of the Florida Department of Law Enforcement's investigative summary. In a letter to FDLE Special Agent Travis Lawson, Hess said his office found Blountstown police officer John Tadlock's actions in the arrest of 57-year-old Barbara Dawson were "appropriate under the circumstances and there was no criminal law violation."

Tadlock was dispatched to Calhoun-Liberty Hospital on Dec. 21 after Dawson refused to leave the emergency room. Dawson was discharged because she didn't feel well. In dashcam audio and video that was released in January, Tadlock told Angela Donar, who is Dawson's aunt and also in the room, "she can walk out peacefully or be arrested."

After refusing to seek health care elsewhere, Dawson was arrested for disorderly conduct and trespassing. The oxygen hose was disconnected and Tadlock walked Dawson out of the facility to the police car, holding her by the arm and nudging her along.

Sometimes I would not blame blacks at all if they started fighting back. It is terrible the way these cops get away with this crap and never have to pay for it. Still not over Freddie Grey.
