Authorities say the Anderson police officer was taking a drunken driving suspect to jail in his unmarked squad car on May 29 when he pulled over and raped her. He then dropped her off at the jail, where she told officials about the alleged sexual assault.

Prosecutors say they may file additional charges at an Aug. 12 arraignment but haven't said what those would be.

Benson is currently free on $500,000 bail.

A three-judge panel of the 9th U.S. Circuit Court of Appeals said Thursday the reasons given by Deputy District Attorney Scott Triplett for dismissing the black prospective jurors "were not sufficient to counter the evidence of purposeful discrimination."

The jury, with one black member, found Jackson guilty in 2004.

Trial evidence included a DNA match between Jackson and saliva found on the victim's body. She also identified Jackson as her attacker.

Prosecutors say they'll ask the full appeals court to review the case

This conviction was tossed for good reason, having to do with jury selection. But, notice that the victim was a 72 year old woman. And Hawkeye has the gall to refer to rapes as being "intimate relationships". There is no "relationship" in a rape, and "intimate" is certainly a misnomer. The description of this crime was "a brutal sexual assault". Let them give him a new trial, and convict him again.
Even grandmothers are not safe from rapists.

A Westminster man was sentenced to 50 years in prison for attacking a woman with a hammer in May 2009.

Paul Scott, 52, of the 1100 block of Muller Road in Westminster, was sentenced at a hearing in Carroll County Circuit Court Thursday.

Judge J. Barry Hughes sentenced Scott to 60 years but suspended 10 years of the sentence.

Scott was convicted in May of attempted first- and second-degree rape, first- and second-degree assault, first- and third-degree burglary and carrying a deadly weapon with intent to injure, after a jury in December was unable to reach a verdict in the case. The jury acquitted Scott of an attempted second-degree murder charge.

Hughes said the charges Scott had been convicted of were among some of the most serious possible, and went above the state's requested sentence of 60 years with all but 40 suspended. Hughes said the fact that it was Scott's ninth assault conviction factored into his decision.

Scott had been accused of attacking the woman, an acquaintance, after going to her house to drop off some newspapers May 10, 2009. Prosecutors claimed he hit her on the head several times with the hammer before attempting to rape her.

The woman repeatedly identified Scott to investigators as the man who attacked her.

She testified that he'd called her and asked if she'd like him to bring in her newspapers, then asked to use the restroom when he got to her house. As she turned around, she was struck on the head, she said.

Scott and defense attorney Spencer Hecht maintained he'd found the woman unconscious on the floor of her home.

The victim told Hughes Thursday the attack has taken a dramatic emotional, psychological and physical toll on her.

Hitting the woman in the head with a hammer wasn't enough. He also tried to rape her. That one sure shows that rape is a violent crime of domination and power above all else. A woman can't even trust an acquaintance who offers to bring in the newspapers for her.

And, Hawkeye, this one includes a rape in a parking garage.

Deputy District Attorney Elliott Sattler praised the judge’s decision.

“If anyone deserves the maximum possible punishment it’s James Michael Biela,” Sattler said.

Co-prosecutor Chris Hicks agreed.

“(Perry) listened to all of the testimony. He’s well aware of the kind of guy Biela is,” Hicks said. “I commend him for the sentence.”

Lauren Denison, Brianna’s aunt, said the family came to court today to support the other two victims and was pleased that the judge ordered a separate sentence for each crime.

“Judge Perry made it count for them,” she said. “He validated the attacks on them.”

Biela, who sat in court in a red jail jumpsuit and a black bulletproof vest, declined to make a statement during the hearing. His family, who lined the row of seats behind him, did not wish to comment.

His lawyer, Chief Deputy Public Defender Maizie Pusich, said she was not surprised by the judge’s ruling but was disappointed.

She said Biela knows they have a lot of work to do as they move forward with their appeals and said he was ready to help. She also said Biela has been polite, professional, pleasant and a model prisoner throughout the process and said he was easy to work with.

After a three-week trial that started May 10, Biela was convicted of raping and murdering Denison in early 2008, raping a college student in a university parking garage in October 2007 and kidnapping and sexually assaulting another student in December 2007.


During the penalty phase of his trial, Biela’s sisters and brothers testified that they grew up in a violent household where their father tied up and beat their mother nightly. While the jurors acknowledges the abuse, they did not believe it negated his attacks, and sentenced him to death.

Ten jurors were in the courtroom today, they said, to see this case through to the end.

Judge Robert Perry sentenced James Biela to four consecutive life prison terms with parole possible after 36 years for raping three women and for kidnapping one of them.
A jury earlier sentenced Biela to death for the murder of Brianna Denison in 2008.

They also found him guilty of raping a woman in a parking garage in October 2007 and kidnapping and raping another woman in December 2007. They also convicted him of raping Denison.

Perry said it was important to sentence Biela on each charge to honor each victim. He also said his highest concern was the safety of the community.

The Sodertorn District Court convicted Lindberg of more than a dozen sex offenses, including aggravated rape and buying sexual favors. He was sentenced to 6.5 years in prison and ordered to pay 300,000 kronor ($41,000) in damages to three of the victims.

The former police commissioner has denied all charges, except a few cases of buying sex.

Lindberg was police chief in the Swedish city of Uppsala from 1997 to 2006. He also headed Sweden's national police academy. As a police commissioner he traveled around Sweden and lectured, often in uniform, to companies and organizations.

Swedish Justice Minister Beatrice Ask has expressed shock over the case, which shook the country's police force.

Isreal received a 43-year sentence. Holmes is scheduled to appear in court Aug. 24.

The youth was only 13 years and seven months old when Wheeling's partially clothed body was found outside a campus building at the Cheltenham Youth Facility in Prince George's County, located southeast of Washington, D.C.

A source told CBS affiliate WJZ that the teacher was beaten with a concrete block and strangled with the lanyard that held her Department of Juvenile Services ID tag.

She was also sexually assaulted.

When Wheeling was killed, the youth was in the custody of the state's juvenile services division because of his involvement in a series of breaking and entering incidents, his defense attorney said Wednesday.

The teen has remained in custody since the slaying and has denied any involvement in Wheeling's death, according to his attorney.

But the source says that the boy's DNA matches the blood and semen found on the victim.

Prosecutors announced in court they'll formally ask for the boy to be tried as an adult at a court hearing scheduled for Aug. 27.

The 14-year-old is currently being held at the Western Maryland Children's Center in Hagerstown, Md.

In the cases that Haweye and I or at least myself we are mainly concern about is couples rapes or so call date rapes not strangers rapes and even then there had been many men that had been lock up for decades by error.

So once more you are being far from honest.

Your being so dishonest on this thread is just an example of why men worry about false rapes charges being place again us.

I am also concerned about the rights of men to enjoy casual sex with women who enjoy casual sex. This is an act of man that will continue, and right now we don't have any just system to deal with disputes that arise out of such encounters.

Read those news stories about rape again. Those were not all stranger rapes. They were not date rapes, but they were not all stranger rapes.

I suggest that both you and Hawkeye address the everyday reality of rape for women, and stop snivelling about how rape laws entrap men.

They should come to some realistic determination of their risk level, stories of bad things happening to other people in the news might or might not help get there. Americans spent well over a decade terrified that their kids were going to be snatched off of the streets because they kept seeing it the nightly news, however in reality the chance that their kid would ever be snatch was done in the one in a million range. The truth was that the owners of the media highlighed these stories because it was good for ratings, it made them money. There were never public safety experts cliaming that this was a big problem, but it was in the media owners best interest for viewers not to know this.

People would have been better off to worry about something that was more likely to impact their life. We only have so much time and energy, let's us it wisely.

There is no "right" to enjoy casual sex without risk. It can be dangerous for both sexes to do that. Putting yourself alone with a stranger carries risks. For the woman, there is a risk of rape, or of physical harm in addition to sexual assault. For the man, there is a risk of a possible false rape charge. But, increased safety comes from getting to know someone first, and not being alone with strangers. Perhaps casual sex should not be so casual. That is a matter of common sense, not of changes in the rape laws.

Unfortunately, that still will not always prevent a rape. Rapes occur because rapists do not care that the woman has indicated non consent to sex. They simply sexually assault her.

However it no big deal if a man is charge falsely with rape from all your postings to date a very minor matter indeed also by your past postings.

It the man fault if he place himself into a position where he could be charge falsely with rape however it is never the false and is a big deal if a woman unwisely place herself into harm way and get rape!!

the collective has no right to impose the risk of false allegation to one party of an act between individuals that it does not approve of. All to often the attitude of the feminist toward innocent men accused is "well if he did not do it someone else surely did and got away with it, so **** him...it sends a good message". Not only is this wrong, it discredits the entire movement, it sends a bad message. You might decide that it is in your best interests to care.
