More taking away the rights of adults to consent to sex.

It was just ten minutes ago that most everyone would turn up their noses when recalling how the church used to interfere in the sex lives of their subjects, but now the state does the exact same thing with nary a quibble. The selling of fear works like a charm nearly every time....it used to be the fear of Hell and now it is fear of the evilness of males which is pitched.

Who was it who said that nearly all humans are like sheep???

@hawkeye10,
What I love is the Fireflies of the world not only picture men as powerful sexual predators but women as sexual sheep that need the state in order to protected their best interests from their own bad judgments.

There is no real differences between how the talibans view women and how the Fireflies of the world view women when it come to their abilities to govern their own sex lives without the state protections.

The bigger problem is the the masses support the state's massive increase in regulating sexuality in particular and intimate relationship in general. Where I grew up, when I grew up, the overwhelming sentiment was that these things were none of the states business.

Secondly, you liberals are going to have to at some point get your head around the fact that this outcome was inevitable when you pushed for the creation of the nanny state. Conservatives are equally to blame, as they have for decades attempted to impose their morality on the nation through the lawmaking process. This attack on human rights was born out of the deterioration of the american political system, which has allowed the state to massively consolidate power over the citizens, with the whole hearted support of both political parties.

Then you grew up unaware of history, and unaware of the fact that the state was trying to regulate sexual behaviors--even between married couples.

Sodomy laws weren't completely invalidated in the U.S. until 2003.
Quote:
Sodomy laws in the United States, which outlawed a variety of sexual acts, were historically universal. While they often targeted sexual acts between persons of the same sex, many statutes employed definitions broad enough to outlaw certain sexual acts between persons of different sexes as well, sometimes even acts between married persons.

Through the 20th century, the gradual liberalization of American sexual mores led to the elimination of sodomy laws in most states. During this time, the Supreme Court upheld the constitutionality of sodomy laws in Bowers v. Hardwick in 1986. However, in 2003 the Supreme Court reversed the decision with Lawrence v. Texas, invalidating sodomy laws in the remaining fourteen states.

In 1778 Thomas Jefferson wrote a law in Virginia which contained a punishment of castration for men who engage in sodomy, however, what was intended by Jefferson as a liberalization of the sodomy laws in Virginia at that time was rejected by the Virginia Legislature, which continued to prescribe death as the maximum penalty for the crime of sodomy in that state.

Prior to 1962, sodomy was a felony in every state, punished by a lengthy term of imprisonment and/or hard labor...

No, not only has there not been evidence of "the state's massive increase in regulating sexuality", the government has moved in the exact opposite direction since 1778 when Thomas Jefferson wrote that law.

And sexual assaults/rapes are not "intimate relationships"--and your failure to understand that, and your failure to distinguish consenting sex between competent adults from sexual assault, has been evident throughout this topic.

Sorry but consensus sex between an adult woman and someone who is teaching a course she is taking is not rape and nor should it be a felony of any kind as is now being put forward. See the article I had posted.

Now the same go for a GP and a patient, a lawyer and a client, a boss and an employee and so on.

We live in a society where there are any numbers of power imbalances between people and those power imbalances is no reason to take away the rights of an adult woman to consent to sex in the name of protecting her.

I am sure Firefly in your ideal world a multi-billionaire having sex with a fairly low level employee of the company he is head of would be illegally due to the power imbalance and therefore Bill Gate should had been arrested for doing so with his now wife Melinda Gates during their courtship as how could she had been trusted to look after her own best interests with such a power imbalance existing at the time and freely consent to having sex with Mr.Gate?

We can not trust women judgment after all and need to place all kind of limits on their rights/abilities to consent to sex and all kind of duties for men to act as their guardians.

You either can't comprehend or else you choose not to.......in the then conservative Rockford I'll post sexual revelution and post antiwar movement the vast majority of people believed that the state had no business regulating sex or intimate relationship. Women who got into situations with men that they could not handle were expected to try to do better next time, there was little interest in looking at those events as victim/abuser, they were examples of incompetence. The conservatives climbing on board with t he liberals to have the state tack charge came after.

@hawkeye10,
You still don't understand the difference between sexual assault/rape and "intimate relationships". Is that because your idea of "intimate relationships" includes sexual assaults/rape?

Currently, the vast majority of people want the present sexual assault/rape laws, and they want violations of those laws prosecuted--whether the victims of such crimes are men or women. And that's true not only in the U.S. but also in Canada, Europe, Australia, the U.K., etc.--where the laws are all similar.

You don't live in the real world.

There are no limits on a competent adult's right to willingly and knowingly and freely consent to sex--whether that adult is male or female.

Find me a law that forbids, or in any way limits, a competent adult from knowingly and willingly and freely consenting to sex.

I want to see the exact law.

The state should tread very lightly on ruling that its citizens are incompetent to manage their own affairs.

The US government clearly does not agree.

@hawkeye10,
But, in fact, some adult individuals are not competent to knowingly and freely consent to sex--and that makes the act of sex with such individuals sexual asault ot rape. And the U.S. government, like the government of Scotland, clearly does agree with that view.

Carer carried out sex attacks on three elderly patients at nursing home
25 June 2012

A carer raped a 65-year-old dementia patient at the nursing home where he worked.

Stephen Murray also confessed to sexually abusing two other Alzheimer's sufferers, aged 84 and 74, at the South Lanarkshire facility.

The 44-year-old was caught by a colleague with his trousers at his ankles and a resident naked from the waist down at the Ashgill home.

On Monday the High Court in Glasgow heard that Murray stabbed himself with a pair of scissors while waiting for police to arrest him when fellow workers caught him abusing the pensioner.

Advocate depute Alison Di Rollo said: "She looked in at two or three of the residents' rooms to see if he was there. When she got to the 65-year-old woman's room the light was off, but the en-suite bathroom light was on and the door was ajar.

"She saw the accused standing at the bottom of the bed. His trousers and pants were at his ankles. The woman was lying on the bed naked from the waist down."

The court heard that when Murray was confronted by his shocked colleague he appeared agitated and embarrassed and said: "My trousers have fell down, my zip's burst."

The care home worker then phoned her manager and the police were contacted.

When he was interviewed at Hamilton Police Station, Murray admitted raping the woman added: "It was stupid. It was stupid, disgusting, because I know it's wrong. I just lost the plot. It was wrong, it was stupid, I hurt her."

Murray, from Larkhall, also admitted sexually abusing two other residents over a 16-month period between December 2010 and April 2012.

Judge Lord Turnbull placed the carer on the sex offenders register and deferred sentence on him until next month at the High Court in Edinburgh.

After the court hearing, Detective Inspector David Tassie said: "Stephen Murray has today pled guilty to a sickening catalogue of crimes which affected one of the most vulnerable sections of our community - the elderly and infirm.

"As soon as the first incident was brought to the attention of police an investigation was launched and a major incident room and specialist inquiry team established. This team of detectives led by myself included specially trained sexual offences liaison officers. The investigation soon established that the initial incident was not an isolated case within the home.

"We are grateful for the co-operation of the families in what was a very harrowing time for them and hope that this admission of guilt will assist them in coming to terms with the effects of these despicable crimes. I would like to reassure the public that we are satisfied that we have captured and acted on all the available evidence and would like to also reassure that Strathclyde Police remain committed to keeping the public safe, no matter where they are in our community."

Procurator fiscal for the West of Scotland, John Dunn, added: "Stephen Murray has admitted to a course of conduct involving the rape of an elderly victim whom he had previously sexually assaulted and attempted to rape. He also admitted sexually assaulting two other elderly women.

"All three of his victims had dementia and were residents at a care home where Murray worked. They were unable to speak or communicate verbally. It is difficult to imagine a more despicable or serious breach of trust."

10 years for Padgate man who tried to rape elderly woman
Thursday 14th June 2012

A 28-YEAR-OLD man has been jailed for 10 years for attempting to rape an 80-year-old woman with dementia.

Jamie Waterworth, of Elizabeth Drive, Padgate, was told by Judge Roger Dutton: “What you did on that afternoon was extremely serious in order to satisfy what one can only describe as some perverted sexual gratification of your own.

“It’s hard to understand why someone of your age can approach an elderly lady in the way you did.

“Perhaps it was committed to exert power and control over her.”

Warrington Crown Court heard how Waterworth launched his attack on the afternoon of Christmas Eve, 2010.

During a week-long trial the court heard how his victim’s condition had declined to a point where she was no longer able to remember the incident and jurors had to watch a video of an interview filmed the day after the attack.

In it the woman told police, ‘he was trying to make love to me’ and ‘I told him to stop but he wasn’t answering me’.

Judge Dutton told Waterworth on Friday: “For this lady the impact was serious. She had at the time a clear recollection of what had taken place. She has deteriorated since then.”

Waterworth had a previous caution for indecent exposure dating back to when he was 13.

Simon Christie, defending, said Waterworth maintained his innocence despite his conviction.

He added the defendant had found life hard from a young age and had turned to drink. Reports showed during the time of the attack Waterworth had been drinking and was two to three times over the drink drive limit. He was ordered to sign the sex offenders’ register for life.

DC Nicola Morgan, from the Northern Area Public Protection Unit, said: “He chose to target the most vulnerable of victims within the community. His actions were despicable.”

The rape of such extremely vulnerable individuals does not involve force--the elderly victims are not able to resist, some are not even able to speak.
And crimes of this sort should leave no doubt about why we need our current sexual assault/rape laws.

Half Of Violent Victimizations Of The Elderly In Michigan From 2005-2009 Involved Serious Acts Of Violence

WASHINGTON, June 13, 2012 /PRNewswire via COMTEX/ -- Perpetrators of elder abuse were often related to the victims

A report released today by the Justice Department's Bureau of Justice Statistics (BJS) found that half of violent victimizations of persons age 65 or older involved serious violence, such as murder, rape, sexual assault, robbery and aggravated assault, based on data from crimes known to Michigan law enforcement from 2005 to 2009.

A family member was identified as the perpetrator in half of violent victimizations against the elderly during the five-year period. The victim's child or grandchild was the offender in nearly a third of the victimizations. An intimate partner was the perpetrator in about 13 percent, and other relatives were linked to about six percent of victimizations.

Elder abuse can take many forms, including physical abuse, sexual abuse, emotional or psychological abuse, financial or material exploitation, neglect and abandonment. Currently, no national data system captures information on elder abuse known to law enforcement; however, the FBI's National Incident-Based Reporting System (NIBRS) collects such data from all law enforcement agencies in sixteen states, as well as many other local jurisdictions. This study focused on incidents of violent physical and sexual abuse of elderly persons known to law enforcement in Michigan from 2005 to 2009, demonstrating how NIBRS data can be used to describe the level and characteristics of elder abuse in a specific jurisdiction.

About 13,220 violent crimes against the elderly came to the attention of law enforcement in Michigan from 2005 to 2009, or about 1.6 percent of the nearly 824,000 total violent victimizations in the state.

Overall, victims age 65 or older experienced the lowest annual rate of reported violence (204.5 violent victimizations per 100,000 persons in that age group), while persons ages 18 to 24 had the highest rate (3,917 violent victimizations per 100,000 persons in that age group). Despite a lower rate of reported violence, elderly victims were more likely than victims younger than age 65 to be murdered or to be robbed.

The majority (63.6 percent) of violent victimizations against persons age 65 or older took place inside a residence (house, apartment, or group quarters such as a residential or long-term care facility). Violence inside a residence typically took place in the late afternoon and evening, peaking around 8 p.m. The victim's child or grandchild was identified as the perpetrator in a third of the violence against elderly males in a residence and in nearly half of the violence against elderly females in a residence.

Other findings of the five-year analysis showed--

Elderly males experienced a rate of reported physical violence (247.7 per 100,000 males age 65 or older) that was 1.4 times higher than the rate for elderly females (172.9 per 100,000 females age 65 or older).

The rate of reported violent victimization by a stranger was more than two times greater for elderly males (65.5 per 100,000 males age 65 or older) than for elderly females (29.2 per 100,000 females age 65 or older).

Among the elderly, persons age 85 or older experienced a rate of rape and sexual assault (11.9 per 100,000 persons age 85 or older) that was three times greater than the rate for persons ages 65 to 84 (3.6 per 100,000 persons age 65 to 84).

An estimated 16.5 percent of violence against the elderly involved a firearm, and the majority of those firearms were handguns.

Four out of 10 elderly victims of violence were physically injured during the incident. An estimated 6.5 percent suffered a major physical injury, including 1.0 percent of victims who died as a result of the attack.

About a third (31.6 percent) of violent victimizations of the elderly resulted in an arrest being made. Offenses committed by the elderly victim's child or grandchild were most likely to result in an arrest (59.7 percent), compared to other relationship categories.

The report, Violent Crime against the Elderly Reported by Law Enforcement in Michigan, 2005-2009 (NCJ 238546), was written by BJS statistician Erica Smith. The reports, related documents and additional information about the Bureau of Justice Statistics' statistical publications and programs can be found on the BJS website at http://www.bjs.gov/ .

The Office of Justice Programs (OJP), headed by Acting Assistant Attorney General Mary Lou Leary, provides federal leadership in developing the nation's capacity to prevent and control crime, administer justice, and assist victims. OJP has six components: the Bureau of Justice Assistance; the Bureau of Justice Statistics; the National Institute of Justice; the Office of Juvenile Justice and Delinquency Prevention; the Office for Victims of Crime; and the Office of Sex Offender Sentencing, Monitoring, Apprehending, Registering, and Tracking. WRONG!!!!!!!!

Here is a link to as article on one such law that had just been strucked down by the Arkansas state SC however this kind of law is still on the books in a numbers of states.

In the article a teacher who was sentence and was serving a 30 years prison sentence under this law for having consensus sex with an adult woman student is now going to be released from prison.

Oh Arkansas is not the only state with such laws on the book "see article".

@BillRM,
The law in Arkansas was not struck down--only part of it was ruled unconstitutional. The Arkansas State Supreme Court ruled that when the student is an adult, over the age of 18, it is not criminal sexual assault in the second degree.
The law pertaining to sexual contact between teachers and students under the age of 18 is still in effect.

Quote:
Oh Arkansas is not the only state with such laws on the book "see article".

Do those laws also apply to cases where the student is an adult? Can you find any of those state laws?
Quote:

The Arkansas law makes no mention of gender of either the teacher or the student. It is intended to protect students--regardless of the gender of the student. It is still in effect for students under 18.

So, currently, in Arkansas, there is no law that forbids, or in any way limits, a competent adult from knowingly and willingly and freely consenting to sex.

You can not protect adults in such a manner without treating them as children and people like you wish to treat adult repeat adult women as children for their own good in sexual matters.

Love you trying to dodge your way out of the situation in your normal dishonest was by trying to drag in sub-adults women as that was never any part of my statement concerning this matter or that in one state only such a law had just been overturn.

By the article such laws are alive and well at the moment in other states.

Michigan Senate passes ban on teacher-student sex, regardless of age
3-21-2012 Michigan:

The Michigan Senate has approved legislation aimed at expanding prohibitions against sex between school employees and students.

The Senate passed the main bill in a legislative package by a 36-2 vote Tuesday. The legislation advances to the House.

The legislation would make it a crime for school employees such as administrators and teachers to have sex with students even if the student is 18 or older.

Current law sets an age of consent in such cases at 18.

Sponsors of the new legislation say that's a loophole that should be closed to prevent a school employee in a position of authority from taking advantage of a student, regardless of the student's age.

The measure would take effect July 1 if it becomes law. ..Source.. by Detroit News

OLATHE, Kan. - A former Shawnee Mission West High School teacher pleaded guilty Thursday to having sex with students.

Michelle Preston, 28, entered guilty pleas to three counts of unlawful sexual relations.

Preston will be sentenced June 1.

The district attorney's office, her attorneys and the victims have agreed to ask the judge to place Preston on probation. Preston also underwent a mental health evaluation to ensure she is not a threat to others in the community.

All of Preston's victims were 16 years old or older, making them of legal age to consent. Johnson County District Attorney Stephen Howe said that factored into the recommended sentencing.

Even though the students were old enough to consent, Kansas laws say teachers are in a position of power and they should not abuse that relationship.

"We think it sends a message that there's a responsibility that teachers have, and when they violate their duties and their responsibilities that criminal charges are appropriate," Howe explained.

Preston taught Psychology, World Geography and served as the freshman cheering coach.

School officials were told of Preston's misconduct in March 2011 and the school board voted two months later not to renew her probationary contract.

Preston graduated from Lansing High School and Baker University.
