LOL as you had said a guy can never proof he is innocent and removed the black mark against his name..............

As far as being anti-women given that women had lied in the past concerning rape is some numbers my statement is no more anti women then a statement that some men are rapist is anti- men.

Any harm that has been to this man's reputation has been done by the media because they had no reason to reveal his name before an investigation was even completed. The woman did not publicly reveal his name.

I repeat...
Don't you believe that women have a Constitutional right to file a criminal complaint if they genuinely believe they have been the victims of a crime?

Sorry dear but that logic is similar to saying that the man is not a killer as he did not harm the other guy it was the bullet from the gun he fired that kill the man.

Oh a woman once was having sexual congress with a boyfriend in the back of his truck when her husband show up and she cry rape.

The husband thinking she was in fact being rape shot and kill the man and guess what she was the one who was convicted of the killing not the husband who acted in good faith.

Did you think for one second that your weak logic would fly in any case as it is the woman who is the one who is pulling the trigger not the news media.

God, are you stupid. Laughing

And you are implying that women have no Constitutional right to file criminal charges when they genuinely believe they have been raped.

In your mind, steeped in bullshit as it is, any woman who files a legitimate criminal complaint is "pulling the trigger" on a man.

Try recognizing the rights of women to file criminal complaints when they believe they have been victims of crimes.

@firefly,
If there is a good faith charges all well and good however there is little or no harm done to any woman who does not act in good faith and that is the problem.

It is a free shot at any guy who piss her off or have $$$$ or for any of a million other reasons that had zero to do with sexual assault.

Strange you are all for harsh punishments for any other crimes but seems to be of the opinion that filing knowingly false rape charges should be the same as filing a false report of a cell phone being riped off for example.

Sorry but it should be one or another neither name released or both names released and if it can be proven that a woman act in bad faith and turn a man world upside down then there should be a few years in prison for the lady not a slap on the wrist at the very best.

@BillRM,
The filing of a deliberately false criminal complaint is a crime against law enforcement--it takes up their time and resources.

Deliberately trying to harm someone by falsely accusing them of a crime, and damaging their reputation is punishable under civil law.

You don't understand the difference between the criminal laws and the civil laws.

Repeating your mindless gibberish incessantly, as you do, doesn't make it meaningful.

One more comment the sexual assaults laws should be written in a manner that the conditions for violating it is clear to any reasonable person with little or no gay areas.

You know using force or the threat of force or drugging that person behind their back and that how it been until the last tens years or so and that is where the laws should return.

The laws should be clear enough that no one could file a good faith rape charge and be wrong about the event being a rape!!!!!!!!!!!!

That would be wonderful if the person happen to had a dime or two of net worth to go after

But in any case knowingly false rape report should be at least a second degree felony and not a misdemeanor as it is now.

Not because of the harm it does in using police resources but because of the overwhelming harm it can do to a innocent man and his family.

Harm that can be just as emotionally damaging to a man then rape is to a woman.

@BillRM,
Look, your obvious cognitive limitations prevent you from understanding the news story you yourself posted.

The only thing that makes the story newsworthy is the fact that the man is the son of the Police Commissioner of NYC and he is also an anchor on a local TV news show. Because of the NYPD connection, the D.A.'s office must do the entire investigation, and that seems to be without precedent, at least in NYC.

The media chose to publicize the story and identify the man even though this was only an investigation and no arrest has been made. Based on the info which has been leaked, it seems likely that no arrest will ever be made. This is one story the media should have ignored at least until the investigation was completed.
The woman went to the police with her complaint but apparently, according to leaked info, could not provide any evidence of rape to support a criminal charge. She was drunk and cannot remember what happened. She believes she was raped, according to one NYC tabloid, because she alleges she became pregnant and then aborted the baby. But she waited 3 months to report the alleged rape, so there is no physical evidence, and she doesn't really remember what took place, but she knows she didn't consent. And she did exchange friendly text messages with the man after that night--and he provided the messages to investigators--suggesting she had no ill feelings toward him afterward.

So, this sort of complaint, under normal circumstances, would probably go nowhere. Thus far, there does not appear to be anything very substantial to support her allegations, and even her memory of events is unreliable. But, because the son of the Police Commissioner is involved, probably more of an investigation will be done than would normally be the case with such a weak complaint. The D.A.'s office must show they took her complaint seriously and that the man was not getting preferential treatment because of his NYPD connection.

Maybe this woman genuinely feels and believes she was raped. Maybe she did become pregnant from her sexual contact with the man that night. But you really can't wait 3 months to report something like that, without any evidence that a rape took place, and expect it to result in criminal charges against someone.

No one seems to strongly believe that the woman's story is very credible or supportable as a serious rape allegation, partly because she waited so long to make her complaint.
Unless some really compelling evidence emerges, that results in an arrest, this man shouldn't suffer any real damage to his reputation. The news stories in the NYC tabloids tend to be biased in his favor.
http://www.nymag.com/daily/intel/2012/01/greg-kelly-rape-claim-text-messages.html?imw=Y&f=most-viewed-24h5

But, I don't think this news story demonstrates much of anything. It's the media who decided to report it, and to reveal the man's identity, because of the sensational aspects of the story.

It may well not be a false allegation at all. The woman may well have been too drunk to consent--she apparently claims she passed out--and he doesn't deny the sexual contact occurred. But, without some supporting evidence, I can't see them arresting this man or lodging charges against him. So, right now, I don't even see this story as being of much interest.
Quote:

Linda Fairstein, former chief of the Manhattan DA's sex crimes unit, said prosecutors will have to think hard about bringing charges against Kelly.

"This woman doesn't come close to establishing her physical helplessness," said Fairstein, who said she has talked to sources investigating the allegations against Kelly, but not to prosecutors.

"I haven't heard anybody establish the elements of a crime."

The sexual assault laws of NYS are quite clearly written and understandable. And to prosecute someone under those laws, there has to be some evidence that the law was violated. It remains to be seen whether the investigation in this case will produce such evidence.

Too bad the boyfriend had have a vasectomy as instead of a phony rape charge she could had just pass the child off as belonging to the boyfriend.

Oh yes I had been drinking so I was in no way responsible for my actions it is all the fault of the evil man/rapist that I went back to my office with him after hours and had sex with him on my boss desk.

The pair had flirted over text messages about getting together, the source says

New York (CNN) -- A paralegal who accused the New York police commissioner's son of raping her inside a Manhattan law firm said the incident left her pregnant and prompted her to get an abortion, according to a source familiar with the investigation.

The woman, described as around 30 years old, told police earlier this week of the alleged October attack by Greg Kelly, a former Fox News White House correspondent and current co-anchor on WNYW's "Good Day New York."

Kelly, 43, the son of New York Police Commissioner Ray Kelly, has since taken a leave of absence from his anchor chair. He has not been charged with a crime.

According to the source, the woman told authorities that over the course of three days in early October, the pair exchanged phone numbers, mutually flirted, talked and exchanged text messages about getting together.

When they finally met for drinks at a South Street Seaport area bar, the woman told police that they each used credit cards and took turns paying, consuming drinks until she became intoxicated, according to the source.

She said she then invited Kelly to her office building where they had sex in her boss' office, according to the source.

The woman, whom authorities are not identifying, described her condition to authorities as "woozy" and said she was not a willing participant, the source said.

She said she later learned that she was pregnant, telling authorities that it couldn't have been from her boyfriend, who had had a vasectomy, the source said.

The woman told authorities she continued to exchange what the source described as nonconfrontational messages with Kelly following the alleged assault.

Later, a man presumed to be the woman's boyfriend sought out the elder Kelly at a public event, according to Deputy Police Commissioner Paul Browne.

The man said to the commissioner, "'Your son's ruining my girlfriend's life,'" Browne said.

"Kelly asked, 'What do you mean by that?,'" added Browne, noting that the man said, "there were too many people around, and so the commissioner told the man to write him a letter."

It's not clear if the man had done so.

Greg Kelly's attorney, Andrew Lankler, said the allegation of rape is false.

"Mr. Kelly strenuously denies any wrongdoing of any kind, and is cooperating fully with the district attorney's investigation," he said in a statement. "We know the district attorney's investigation will prove Mr. Kelly's innocence."

He said his client is "cooperating fully."

The scandal leaves Manhattan District Attorney Cyrus Vance Jr. again confronted with a sex scandal that bears implications far beyond the courtroom. Vance was involved in the sexual assault case against former IMF chief Dominique Strauss-Kahn last year. A hotel maid accused Strauss-Kahn -- once considered a leading French presidential candidate -- of assault during an encounter in his room at New York's Sofitel. The charges were ultimately dropped.

Vance's office has taken over the Kelly investigation to avoid possible conflicts of interest by would-be police investigators, said a source with knowledge of the probe.

His office, which fended off criticism over its handling of the Strauss-Kahn case, has remained largely tight-lipped about how prosecutors are dealing with the Kelly investigation.

Linda Fairstein, former head of the district attorney's sex crimes unit, said she's confident Vance's office is well-positioned to handle the Kelly case.

"He could have kicked it out of the county, but it's not a conflict for him," Fairstein said. "It all comes down to what his investigators can do."

Some of those investigators, she said, are former police officers who are capable of pursuing the case.

Two days before the Kelly allegations surfaced this week, the newsman interviewed Vance about the handling of the Strauss-Kahn scandal.

Prosecutors ultimately dropped that investigation due to apparent gaps in evidence and credibility questions about Nafissatou Diallo, the hotel maid.

"Your office chose not to prosecute Dominique Strauss-Kahn for sexual assault, an alleged sexual assault," Kelly said to Vance on "Good Day New York." "A lot of people were frustrated. They thought Nafissatou Diallo had a strong case that should have at least gone to trial. Why did your office decide not to prosecute DSK?"

Vance responded that he felt he could not prosecute "beyond a reasonable doubt."

"Our job as a prosecutor's office is not to put points on the board," Vance said during the interview. "Our job as a prosecutor's office is to try to do right. To pursue every case to where it should end up appropriately."

The investigation is the latest high-profile case before Vance, who has often been seen as a reformer, following a series of sexual assault cases that has left his office open to criticism.

In addition to the Strauss-Kahn case, Vance's office presided over an investigation of two New York police officers who were acquitted in May on charges of raping a 27-year-old woman whom they had helped home. A jury acquitted the men of felony rape and burglary but found them guilty of official misconduct, a misdemeanor.

Vance is the son of Cyrus Vance Sr., who held various high-level Cabinet positions, including Secretary of State under President Jimmy Carter.

@BillRM,
What renders your opinions easily dismissed is the very obvious bias you have consistently and constantly displayed in your posts throughout this thread.

So, big deal, you believe woman generally lie when they make rape accusations.
You distrust women, and your comments reveal your low opinion of women.

But, beyond those obviously biased opinions on your part, which seem to sum up what little you have to say on the topic of this thread, you are unable to consider the issue with any degree of objectivity.

In the particular news story we are discussing, you have apparently already decided the woman is deliberately lying. As usual, you have done this without any objective evidence that she has fabricated her account.
In addition, what little is known of her actual complaint to the police has emerged only through "leaks" to the media and it is unknown who is leaking the information--it may well be the defense attorney, or the PR rep of the man, who would have a vested interest in trying to discredit the woman in the public mind, even if it involved distorting or misrepresenting the information.

That you are so gullible, and so quickly believe leaks, as long as they fit into your preconceived ideas about women, again reveals, not only your bias, but your inability to critically evaluate information. And, interestingly, if you can so quickly dismiss this woman as being a liar, you substantially discredit your entire argument that such accusations cause irreparable damage to the man involved--if you know she's a liar, surely most people can see that as well, and no one would believe that the man has done anything wrong, so there is no lasting harm done to his reputation and "good name", particularly if no arrest occurs in this case. The sensational news story will blow over and his life will go on as usual. The woman will be easily dismissed as a crack-pot or someone who was trying to disguise a consensual indiscretion on her part.

If this woman alleges that she was willing to engage in sexual foreplay, but not in intercourse, and that when the man attempted penetration she said, "No" but could not offer much physical resistance, because of her intoxicated state, and he penetrated her anyway, that would constitute rape under NYS law. It is a typical date rape scenario. And, since she allegedly reported that a pregnancy resulted from this intercourse, her lack of consent might have been related to the fact he was not using a condom. There is nothing implausible about that version of events, if that was the type of account she gave to the police. And I have a feeling that is the type of account she did give, and it is the reason why the complaint must be regarded seriously--it is consistent with rape, as defined by NYS law.

The problem in this case may well be the lack of any additional evidence to support her account, which does not mean that her accusation was false or intentionally malicious, or unfounded, it would simply mean that the prosecution could not go further with the case in terms of an arrest or charges. To prove that a rape occurred, and that a law was violated, requires some evidence that the state can use to justify that assumption. It remains to be seen whether the investigation will, or won't, turn up such evidence.

At this point in time, her accusation should be regarded as valid and truthful, since there is no evidence to the contrary, and the man should be regarded as innocent, since there is no available evidence to the contrary beyond the leaked tid-bits of the woman's complaint, and reportedly her memory of the events of that night might be hazy, spotty, or impaired.

For that reason, the job of the D.A's office is to be scrupulously fair to both parties, as they should be in all such cases. The lives of both people involved require that. And because this has become such a high profile case, the investigation by the D.A.'s office must be as thorough as possible because any decision they make, regarding whether to proceed with the case, will come under intense public scrutiny. No matter what they decide to do, they will wind up being criticized, so they certainly will need adequate justification for any decision they do make.

You apparently aren't willing to wait for the investigation to be completed, to see what evidence might emerge. You've already launched into your obsessive false accusation rant. And, by doing that, you've discredited yourself in terms of any ability to evaluate this case with any degree of objectivity.

@firefly,
Sorry dear the story have all the ear marks of a woman trying to cover her ass for getting pregnant by someone other then her normal sexual partner and the chance that even Vance will bring this to trial is near zero.

Still as you had said there is no way for a man to completely clear his name once charge by a woman and for the rest of this man life he will always carry a question of whether he is a rapist or not. There is no way in hell he can be make whole after his name had been link with a rape claim no matter how unfounded.

As far as having contempt for women I do have great contempt for women who will cry rape in an attempt to cover up their own misdeeds and regrets at the great expense of the men they single out as their victims.

Such behaviors by women is every bit as bad and evil as men raping women.

But do not feel bad for this lady as her name will not at all likely ever be a matter of public records and that is a damn shame.

There in fact should be a public data base of such women that a man thinking of picking up a woman could check using a smart phone so he could be warn of the risks of being alone with such a woman let alone having sex with her.

The men are always "innocent", none of them ever disregard the need for consent.
Quote:

Sorry, "dear", you don't know the story. You are simply gullible enough to believe "leaks" in the tabloids, leaks that might be inaccurate or distorted and deliberately planted by the defense.
If her contention that she became pregnant is true, the apparent lack of condom use might also explain why she might not have given consent for penetration--if anything, that lends her complaint credibility. The man was a relative stranger to her, in addition to fearing possible pregnancy from penetration, she might well be concerned about STD's. So, while she might have been willing to engage in foreplay, it is plausible that she drew a line at penetration and tried to resist, and did indicate her lack of consent. And, "the story" you have heard would not discount that possible scenario, and that scenario would be rape under NYS law.

Vance may well not take this case to trial because the investigation might not uncover enough supporting evidence, partly due to the woman's long delay in reporting the complaint. But again, that does not mean the complaint was deliberately false, or malicious, or unfounded, it simply means that there is not enough evidence to erase reasonable doubt and take the case to trial.
Quote:
But do not feel bad for this lady as her name will not at all likely ever be a matter of public records and that is a damn shame

Actually, in this particular case, those tabloid "leaks" have given quite a bit of identifying information about this woman, which is one reason I think the info is coming from the defense, to put pressure on her. They've identified her as a 30 year old paralegal, they may have named the law firm she works at, and they've said she is the daughter of a prominent attorney, and that her boyfriend is much older than she is. That alone makes her identity known to a lot of people who can figure out who she is. So, it is not as though her identity is being securely protected.

The shame in this story is that the media has chosen to run with it, and expose this man to it, before an investigation was even completed. That's who has violated the man's privacy, and exposed him to needless speculation, just for the sake of a sensational story that, at best, was done too prematurely.

And your clearly subjective opinions on this matter are nothing more than your usual, extremely redundant, sexist gibberish.

Not all women but in date rape situations the numbers of false charges are not small (see the studies that had been posted more then once on this long thread) with special note of women who had a reason to cover up such as cheating on her partner.

To be fair to this woman I do not think it is likely she was planning on the rape story to be anything more then a private lie to her boyfriend to explain why she was throwing up in the morning and getting fat to him when he could not be a father.

But also from the story the boyfriend not only bought the story but went so crazy that he confound the man father over it.

She found herself trapped by her own lie and in fact there are two males victims the trusting boyfriend and the poor man who is reading in the news how he is accuse of being a rapist.

The woman is a paralegal in a law firm, her father is a prominent attorney, she knew exactly what would happen if she lodged this rape complaint. And she knew her character would be unfairly publicly assailed by sexist idiots just like you who choose to believe tabloid leaks. And that does mitigate against this being a false accusation that was made only to appease her boyfriend.
She knew what she'd be in for with this case, because of it's high profile nature, and an intelligent women, who is also a paralegal, would have to be out of her mind to make a deliberately false accusation that could easily be discredited by an investigation--it would be pointless for her to do that, because the lie wouldn't wind up satisfying the boyfriend either. So, I don't think your line of reasoning even makes much sense.

If anything, it is more likely she is telling the truth--that she did not consent to sexual intercourse that night, and she was too intoxicated to offer much resistance. But the D,A,'s office may well not be able to come up with enough evidence to support any criminal charges. And that's also true in most date rape situations. There is nothing new here.

You might as well continue talking to yourself, since you're the only one who believes your nauseatingly repetitive sexist crap.

Zero will happen to her so yes she know that at the very worst she could be charge with a misdemeanor and that would be unlikely to happen.

As I said I think she told this story to begin with as a way to avoid problems with her boyfriend and it got out of hand as far as law enforcement becoming involved.

Boyfriend or others got her in the position where she needed to either admit the truth or file a charge on the guy.

She is hardly the first woman who had falsely cry rape under these conditions and she will not be the last either.

In fact in this long long thread I and others had posts examples of rape crying to avoid a boyfriend angry over cheating.

In fact one woman claimed a gang rape for that very reason and it was too bad for her that one of the males had video tape the "rape" but great for the poor guys.

Here are a few current examples and take note in the UK women can even find themselves lock up over this matter as they do not seems to take it as lightly as we do.

Girl, 16, who cried rape after cheating on boyfriend is jailed for six months
By Daily Mail Reporter

A teenage girl was locked up for six months today for crying rape - after she lied to stop her boyfriend finding out she'd cheated on him.
The 16-year-old girl made up the rape allegation after going home for sex with innocent Alex Lewis, 20, on a night out.
She lied to police that she was abducted, attacked and forced to perform a sex act during a violent assault by three men.
Innocent: Alex Lewis, left, was falsely accused of rape by a 16-year-old girl (whose face is obscured for legal reasons). He spent 36 hours in custody

It led to Mr Lewis being arrested and held in custody for 36 hours. He spent two months on bail until the girl confessed it was all lies.
The girl, whose name cannot be revealed for legal reasons, admitted she was worried her boyfriend would be furious at finding she had sex with another man.
Her lies unravelled when she was caught on CCTV drunkenly kissing and fondling Mr Lewis on the night out.
A judge yesterday ordered the girl should not be named - even though three innocent men she accused of rape were identified in court.
The trio, all aged 20, were arrested, quizzed and forced to give ‘intimate’ samples during their ‘terrifying’ ordeal after the girl's false claims.
Prosecutor David Pugh said: ‘She said she was pushed up a metal ladder to an attic bedroom by two men, one of whom held her down.
‘She said both kissed her all over her body and was raped by one of the men.’
But the girl's lies were uncovered when detectives viewed footage of her picking up the group in Merthyr Tydfil town centre in South Wales and kissing one of the men, Alex, before they jumped in a taxi together.
Mr Pugh added: ‘Images showed they became very close, with the girl kissing Mr Lewis and placing her head on his shoulder and getting in a taxi.’
They returned to Alex's parents' house and had consensual sex before the girl left and flagged down a police car, claiming she had been raped.
The girl was arrested and admitted making up the claims in June this year.

Cheating wife cried rape in text message to husband after fit of guilt over affairBy Chris Brooke

A wife who cried rape because she felt guilty about cheating on her husband in their home was spared jail yesterday.
Helen Dalby went to extraordinary lengths to stand by her false claim, having a full medical examination and even helping create an e-fit of her imaginary attacker.
But despite wasting £3,800 of public money and showing little regard for two men arrested, she was given a ten-month suspended jail sentence after admitting perverting the course of justice.
Wife who cried rape: Helen Dalby with husband Isaac on their wedding day in 2005. She was given a ten-month suspended jail sentence after admitting perverting the course of justice
Judge David Tremberg told 35-year-old Dalby: 'The men (who came under suspicion) no doubt will have wondered what might have happened to them if this nightmare did not go away. Your lies diverted a massive amount of precious police time and resources from proper duty.'
Dalby's behaviour risked weakening the cases of genuine rape victims and allowing dangerous offenders to be acquitted, he added. In similar cases prison sentences of up to two years have been imposed.
But the judge ruled this case was 'exceptional' because Dalby did not act out of 'spite or malice', and imposed a more lenient sentence.
Yesterday she was back home with her husband Isaac, who has faithfully stood by her.
Problems with their sex life caused by his long hours at work had driven Dalby into the arms of another man, he said.
'I've been hurt by Helen but I don't want to lose her,' added 35-year-old cleaner Mr Dalby. 'She realises she is lucky not to go to prison. It is terrible what has happened for these two men and their families.'

Dalby had a three-month affair with a man she met through a telephone dating service, the court heard.
On 15 August, she had consensual sex with her lover at home in Grimsby before texting Mr Dalby to tell him she had been raped by a stranger.
David Cammies, prosecuting, said she later pretended to police that a man had followed her home, pushed her inside and attacked her in a bedroom.
Officers launched an investigation, seizing clothes, bedding and a cigarette butt.
Two innocent men - including her lover - were arrested and spent 'many hours' in custody before her lies were exposed, the court was told.
Outside Grimsby Crown Court, Dalby said: 'I am very, very sorry. It is the biggest mistake of my life. I didn't want to hurt anybody. Once I had said it, Isaac said we should call the police. It just snowballed.'
Police expressed surprise at the sentence and urged victims not to be put off from reporting genuine sex attacks.
