I guess we will have to wait for more facts on this case but why would an adult take a high school student to the mayor's office at night no less?

To get her into a situation where he could have sex with her. He was ostensibly helping her to get her boyfriend bailed out of jail. Going to the mayor's office might have seemed legitimate to her given the boyfriend's legal predicament.

Whether this was, or was not, rape, this man has very lousy judgment. I guess the mayor realized that, and didn't appreciate having his couch used for such purposes.

Oh I agree. That's pretty much a smoking gun as far as I am concerned.

Have you noticed that they can't respect or address the notion of "consent" even when the issue has nothing to do with sexual assault?
consent theory is useful, to a point. My complaint is the unreasonable level of consent that the law demands, as you well know.

Quote:
Someone should also tell Hawkeye it is already illegal for him to open his wife's regular mail without her consent
we subscribe to the idea that what is mine is hers and what is hers is mine, so I suppose that I have consent though we have never talked about it re the mail. Sure, I open mail addressed to her. I have never been interested in being a couple only in the sense that we live in the same place and ****, if we are together then we are a team, we share all assets and liabilities. I suppose that she could legally say no but it would not make any difference as she would no longer be my wife. Some people call it abuse, I call it my terms, and I really dont give a damn what other people call it as they can do what they do and I do what I do.

This is the sort of case that causes Hawkeye to whine about the "state removing consent after the fact". Except legal consent never existed in the first place--she was underage, and he's twice her age. That makes it rape.

Trial date set in master-slave sex case
By KATY SWEENY-Staff Writer
12/29/2010

OROVILLE — A 35-year-old man who allegedly played sex slave master with a 17-year-old in Chico, was scheduled for a January trial on Tuesday after he tried to fire his court-appointed attorney.

Draco Flama and his attorney, Leo Battle, had a closed-session discussion with Butte County Superior Court Judge Clare Keithley Tuesday, during which she denied his motion to fire Battle.

Flama allegedly met the victim online when she was 15 and met up with her at age 17 in October in Chico. They allegedly had consensual sex while staying together for a few nights under a Chico bridge and on the Chico State University campus.

When the victim returned home, she told her mother and sister, who contacted law enforcement.

Flama has a prior 2010 conviction in Kansas for sexual battery of a 17-year-old, deputy district attorney Lynda Hunt said.

"He is a self-described deviant, sadistic slave master," Hunt said. "She admits she played the role of a slave. This is the same type of relationship he had in Kansas."

Flama is charged with unlawful sexual intercourse, sodomy of a person younger than 18, oral copulation of a person younger than 18 and sexual penetration by a foreign object of a person younger than 18. He could face five years in prison.

At a Dec. 14 pretrial hearing, Judge Steven Howell ruled there was sufficient evidence to hold Flama on the charges.

The defendant pleaded not guilty to the charges Tuesday.

Flama is scheduled to go to trial Jan. 24 with a trial readiness conference Jan. 11. He remains in custody at the Butte County Jail on $190,000.
As the defendant left the courtroom Tuesday in a green jail jumpsuit and shackles, he talked to himself about being released on his own recognizance.

wrong, this is a case that illustrates the states unreasonable AOC. Considering that the alleged victim seems to not feel that she is a victim there should be no prosecution even with the current AOC. It is rare for a victimless crime to warrant state attention..

How do you know whether she feels like a victim? She is apparently cooperating with the prosecution. Presumably she will also testify against him.

Rape--including statutory rape--is not a victimless crime. You just think it's all right for a 35 year old to take advantage of a 17 year old. You also think possession of child pornography is a "victimless crime".

I take that she felt no compunction to report a crime as evidence that she does not feel like a victim.

How do you know that she was taken advantage of? The state denies a person of her age the right to consent out of fear that they will be taken advantage of, but this is certainly not the situation in every case, or maybe is even rarely the situation, and we have no information that it is the situation here.

@hawkeye10,
You must have difficulty reading--or comprehending. She did report the crime--to her mother and sister--which is an appropriate way for a minor to handle the situation. The case could not have gone forward without her cooperation because they needed, and apparently got, her testimony.
A 17 year old in a master/slave relationship with a man twice her age sure does suggest she was taken advantage of, particularly since she was only 15 when she first met him online.

It seem we do not have a problem with rape so must as the country is being full up with women going around in an alcoholic/drug hazy. Oh, also the feminists stand that when two drunks had have sex it is in fact a rape of the woman by the man not just two drunks having sex.

Quit being such an idiot, Bill. She reported it to those who could determine what should be done.

Were you born stupid, or did it take you 60 some odd years to get that way?

@Intrepid,
Yes indeed the feminist goal is to see how how large of the total male population they can find an excuse to place into prison for sex crimes.

Yes the world will be a far better and safer place if we lock up for twenty years every young man of eighteen plus years for having sex with his 17 years old girlfriend just to start with.

The world also will be safer and far better if we lock up the male member of every couple who had have drunken sex.

At a guess doing those two things alone will allow us to go from having two percents of our total male population behind bars to at least 20 percents.

Adding rape by fraud and the others lovely consent games the feminists should be able to place at least another ten percents of all men behind bars.

Hawkeye you are one hundred percents correct the goal of the feminists is to turn all heterosexual sex acts into a game of Russian roulette for men.

Good news! I have the absolutely perfect solution for Bill and Hawkey! Why I did not think of this before I do not know. But I had this "revelation" this morning Wink

Bill and Hawkey need to go and find a polygomist Mormon sect and join! That way, they can have sex with as many underrage girls as they want and justify it by saying they are married in the eyes of God! Now, I am not sure that Bill ever said that he thinks it is okay to have sex with a 15 year old but I am quite sure that his buddy, Hawkeye, won't have too much trouble in twisting his arm.

Think about it! It's perfect! They won't even need consent so Hawkeye would never have to worry about the issue of consent being brought into play! Why Hawkeye could probably even start a Mormon BDSM group. What could be a better solution? He doesn't like the laws set down by society so this way he can make up his own.

I do not know what prison Warren Jeffs is in but I'm sure he could google it to find out. I am sure that Mr. Jeffs would be more than happy to explain just how to go about forming your own religious sect, having as many child brides as you wish, etc.

He wouldn't have to keep child porn on his computer either. He would have real live child porn in his very own home. There are just too many benefits to this solution for him!

Oh, but there is one drawback though. IT'S ILLEGAL! But wait, Hawkeye and Bill do not care about the legalities. We know Hawkeye would break the law if he did not think it was a fair law because he has told us that from his very own mouth. I do find it the height of arrogance that they think they are so far above the rest of society (except for their ilk, that is) that they can totally disregard what the law says.

In a way, their view of the legal system is much like the new age movement in Christianity. The new age Christians think the church has had it wrong all these years just like Bill and Hawkeye obviously think the rest of the country has had it wrong all these years. Isn't it wonderful? Hawkeye and Bill are just like Batman and Robin, Superman and Lois Lane (close enough if you ask me), Rocky and Bullwinkle--------------------are rushing to the aid of society and are going to fix it for us!!!!!!!!!!!! They have all the answers to these stupid ole laws that are set in place to protect society! We should be thanking them because if they have their way, WE GET TO BE JUST LIKE THEM!!!!!!!!!!!!!!!!! Woohoo! How's that for a thought first thing in the morning not to mention the picture in one's mind of those two in tights.

The very reason we have laws in this world are because of people like Bill and Hawkeye. People running around this planet thinking whatever they want to do should be okay to do because well, that's what they want! They have no regard for the "collective" as Hawkeye so mechanically calls humanity. This has been plainly and nauseatingly seen over and over again.

We, as citizens, are not at liberty to "consent" to illegal acts and think that we can do so with impunity. Having sex with a 17 year old is an illegal act. It doesn't matter if she said yes or not. If it's illegal, then it's illegal, and that means you don't do it. That is the way our justice system is set up. It may not be perfect but it's what we have and I'll take it over Sharia Law any day.

Maybe Bill and Hawkeye should try saying over and over again, "Consenting to an illegal act never makes it a legal act. Consenting to an illegal act never makes it a legal act. C'mon Bill and Hawkeye, you can do it.........Consenting to an illegal act NEVER makes it a legal act."

It doesn't matter what your stature in life is. You could be a victim or rapist:

Quote:
Former Israeli President Convicted of Rape
Published December 30, 2010
Associated Press

JERUSALEM – Former Israel President Moshe Katsav was convicted Thursday of raping an employee when he was a Cabinet minister, the most serious criminal charges ever brought against a high-ranking official and a case that shocked the nation.

Katsav, 65, likely faces from four to 16 years in prison for the crimes, which included two counts of raping an employee in 1998 when he was tourism minister and lesser counts of indecent acts and sexual harassment involving two other women who worked for him when he was president.

Katsav served as a minister in several right-wing Likud governments before he was elected president, a largely ceremonial post, in 2000. He has denied the rape charges, claiming he was a victim of a political witch hunt and suggesting he was targeted because he comes from Israel's Sephardic community. Sephardic Jews, of Middle Eastern origin, were for decades an underclass. Katsav was born in Iran and immigrated to Israel as a child.

A somber Katsav left the courtroom without commenting, surrounded by his legal team. He was ordered to surrender his passport while awaiting sentencing at a date that has not yet been set.

Katsav can appeal the verdict, but legal experts said Israel's Supreme Court was unlikely to overturn such a sweeping conviction. A presidential pardon is also highly unlikely because of the severity of the offenses. In his ruling, the judge said Katsav's defense was full of lies.

Katsav's son Boaz vowed his father would clear his name.

"We will continue to walk with our heads high and all the nation ... with God's help, will know that father, the eighth president of the state of Israel, is innocent," he said.

One of Katsav's lawyers, Avigdor Feldman, said he hopes his client will appeal, but he has not yet decided how to proceed. "I don't know how strong he is, how long he can continue this saga," Feldman said.

Katsav's case initially broke in 2006, when the then-president complained that a female employee was extorting him. The woman then went to police with her side of the story, detailing a series of sexual assaults and prompting other women to come forward with similar complaints.

According to the indictment, Katsav forced one woman to the floor of his office at the Tourism Ministry in 1998 and raped her. A second time that year, he summoned her to a Jerusalem hotel to go over paperwork and raped her on the bed in his room. The indictment alleged that Katsav tried to calm his victim by saying: "Relax, you'll enjoy it."

The indictment also alleged that he harassed two women during his term as president, embracing them against their will and making unwanted sexual comments.

On Katsav's 60th birthday in 2005, an assistant offered congratulations. He then hugged her at length, sniffing her neck, according to the indictment. She complained to police, and the indictment said Katsav later tried to persuade her to change her testimony, earning him an additional charge of obstruction of justice.

The conviction by a three-judge panel was widely praised as a victory for Israel's legal system and for women's rights.

"The court sent two clear and sharp messages: that everyone is equal and every woman has the full right to her body," Prime Minister Benjamin Netanyahu said in a statement. He called the verdict a sad day for Israel and its citizens.

The conviction capped a four-and-a-half year saga that stunned Israelis, both with its lurid details and bizarre twists and turns.

Katsav resigned in 2007, two weeks before his seven-year term expired, under a plea bargain that would have required him to admit to lesser charges of sexual misconduct. He was replaced by former prime minister Shimon Peres.

But in a dramatic reversal in April 2009, Katsav rejected the deal, which would have kept him out of jail, and vowed to clear his name in court.

Around that time, he held a bizarre news conference in which he lashed out at prosecutors and the media and denied any wrongdoing. His erratic behavior, in which he shook in anger, waved a computer disc that he said proved his innocence and screamed at reporters in the room, raised questions about his state of mind at the time.

The president in Israel is head of state but a largely ceremonial post, representing the country at ceremonies around the world. The post, filled by parliament, is traditionally given to an elder statesman as a reward for years of public service.

Katsav's case sparked a high-profile campaign by woman's right groups. On Thursday, hundreds of women stood outside the courtroom holding signs against Katsav and chanting: "The whole nation knows Katsav is a criminal."

Prosecutor Ronit Amiel said the verdict sent a strong message that victims of abuse of power should not keep silent.

"This day is not a happy day. It is not an easy day," she said.

Oren Gazal-Ayal, a professor of criminal justice at Haifa University, called the verdict a "badge of honor" for the country's legal system.

"I think we should be very proud of the Israeli justice system," he said. He said that while Katsav's crimes could carry a total of nearly 40 years in prison, under Israel's legal practices, sentences are served concurrently, so the maximum penalty would not exceed 16 years, the top penalty for the rape convictions.

The conviction was the latest in a series of high-profile cases against Israeli officials.

Former Israeli Finance Minister Avraham Hirchson is currently in prison after being convicted of embezzling more than $600,000 from a workers union. Former Justice Minister Haim Ramon was convicted in March 2007 of forcibly kissing a female soldier. Former Prime Minister Ehud Olmert is currently standing trial on corruption charges.

Arella Mae, I love your "revelation" --it's perfect. But, I can't get the image of Bateye and Robill, in tights, out of my mind. Laughing

I can just see them, their capes drooping, their tights bagging at the knees, forming the perfect master/slave duo, with Robill uttering, "Yes, Master," to Bateye's every command and fawning and groveling for his scraps of approval like the obedient lapdog he is, while Bateye gazes at his own image in a hand mirror, pursing kisses to himself. The Ridiculous Duo in all their glory.

@Arella Mae,
Bravo to the Israeli legal system for holding a former President accountable for his rapes and sexual assaults.

Now I hope our own military will take a look at the high number of shameful reports of sexual assaults against servicewomen, and some servicemen, by their colleagues in uniform. That, for years now, the military has refused to make public the records of such assaults, is an absolute disgrace. Hiding the facts, or trying to sweep them under the rug, will only let this problem fester and increase. I hope the ACLU lawsuit, to have these records released, will be successful. The women and men who serve our country deserve to be protected from sexual violence and sexual harassment from their fellow officers and it is high time some effective action was taken to address this problem.

I could not agree with you more. Did you ever see the movie The General's Daughter with John Travolta? It was really a very disturbing movie but I imagine it depicted rather well what goes on in those cover ups.
