If they are not wearing uniforms or other identifying insignia,if they dont fight for or answer to a centralized command structure,if they refuse to recognize the rules of war,they qualify.
Specifically,I mean the Taliban in Afghanistan.

What law states failure to wear a uniform makes them a terrorist? You seem to confuse unlawful combatant with terrorist.
The Taliban had a command structure by the way. So your argument fails from that standpoint.

Tomorrow morning, the questions begin. The issue of presidential power to bypass congressional enactments is going to be a paramount topic. Alito is one of the architects and proponents of an aggrandized presidency.

Both democrats and main-stream republicans are deeply concerned about the president's claimed inherent power to disregard the rule of law. During Roberts' confirmation hearing, Roberts stated that the PRESIDENT IS NOT ABOVE THE LAW. Several senators have asserted that Alito needs to vocalize the same thing and reassure them that he will be neutral and INDEPENDENT jurist rather than a proponent of an aggrandized executive branch.
