I suppose you can claim anything you wish — the problem arises because people belonging to racial minorities are assumed to face discrimination so if you "pass" for white you don't don't suffer from the effects of racial prejudice. I doubt that Warren was ever turned down for a job or denied her civil rights because people
perceived her as a Native American. I've heard conflicting stories about whether she parlayed her ethnic status to secure entry into law school.
