Justice Department Declines to Support Blocking Hillary Clinton Deposition

The most notable thing about the case is the extreme lengths to which Hillary Clinton is going to avoid answering questions under oath about her email practices — a matter on which she has made a slew of contradictory public statements, some of them proven untrue by the FBI’s criminal investigation. The Justice Department’s decision to take a pass on her latest maneuvering is an unremarkable application of standard DOJ guidance, and it will make no difference to the appellate court’s resolution of the case.

Last month, Democrats tried a new way of blaming Trump for the coronavirus outbreak. Former New York City Mayor Mike Bloomberg claimed during the Democrat debate in South Carolina that Trump “fired the pandemic specialist in this country two years ago, so there’s nobody here to figure out what the hell we should be doing. [Applause] And he’s defunded Centers for Disease Control, CDC so we don’t have the organization we need.”

Breitbart News rated that “Mostly False.” We noted:

In reality, the pandemic expert — Rear Adm. Timothy Ziemer — left the National Security Council (NSC) voluntarily after then-National Security Advisor John Bolton was appointed.

Bolton disbanded the unit that Ziemer was supervising as part of an effort to downsize the bloated NSC staff…

The Trump administration has indeed proposed cuts to the CDC, but they have not been passed by Congress.

Judicial Watch argued in their lawsuit that the appeal must not be granted for a number of reasons:
In our response, we argue that Clinton and Mills “must demonstrate that they have no other adequate means of relief,” which they failed to show… In fact, “the District Court reasonably concluded that Clinton’s previous explanations for using a personal email server are cursory, incomplete, and seemingly at odds with what discovery has yielded to date… We argue further that Clinton and Mills are trying to avoid their deposition testimony by relying on “their status as former high-level government officials.” Clinton and Mills, “do not offer a single case from this Court or any other, holding that former high-level government officials should not be required to follow regular appellate channels to challenge a discovery order”…

We also argue against Clinton’s claim that she held the server under “claim of right,” when it contained thousands of federal records. Judicial Watch states that unlike other secretaries of state, like Henry Kissinger, Clinton did not obtain an opinion from State’s legal adviser on whether she could take the federal records prior to her departure from State. Clinton’s “claim of right” argument over her server would be like a bank robbery.

Rep Adam Schiff:

The Rev. Franklin Graham on Tuesday accused elected officials and others in New York of harassment over their criticism of his medical organization, which is operating a field hospital in Central Park for coronavirus patients that requires workers to sign a pledge that they are Christians who oppose same-sex marriage.

Mr. Graham posted his accusation on Facebook hours before Mount Sinai Health Systems, which teamed up with his organization, Samaritan’s Purse, last month, informed state lawmakers that it would begin requiring those who work for the group to sign a second pledge vowing not to discriminate against patients.
