Agreed, but it is still startling that he didn't decide to let it go to the full court and therefore allow the current redistricting to hold for this election.

He had no choice. Each associate have a region of states and appealed state cases in their district is decided on independently by them. The only choice he gets is to let stand, send back for cause or send on to the full Court. But, it has to be under his name.

That take was my conclusion too. I think though they would have to include all the other states that are gerrymandering in a "whole court" decision. Then the whole of SCOTUS would rule for the whole of the country. It would more than likingly rule that gerrymandering is still not legal and all states in violation would have to remap. As it stands now, only Pennsylvania has to remap. Better for the Repugs the way he decided.
