It's too bad there weren't other armed people in the restaurant to gun the man down.

The man told police he was arguing with his neighbor, possibly an "uncle," in front of his home on E Seltzer Street in the Kensington section of the city around 7:45 p.m. The man claims his neighbor pulled out a hammer and threatened him during the heated exchange.

Police sources told Jaquez the argument with the uncle was over $50.

The man says he was scared for his safety and pulled out a gun but then tripped over his own feet and accidentally pulled the trigger, shooting his 27-year-old girlfriend in the neck. She was taken to the hospital where she died.

The Marion County Sheriff's Office says Kenneth Fagin was in his Kelly Cove Road home working on his 9mm gun. They say he'd just put a firing pin in it, and stepped out on the back porch to test it out.

"He thought he was in the house and the woods was real thick so he didn't realize the son was in the woods," Marion County Sheriff Ronnie "Bo" Burnett says.

When Kenneth Fagin fired the 9mm into the woods surrounding his house, the bullet shot 200 feet straight into his 13-year-old son's left shoulder.

"Another couple inches, it could've been fatal," Sheriff Burnett says.
