The Patriot Act expanded FISA. Despite that, Bush went behind Congress and changed the law to what he wanted, even after Congress had denied him the authority to eavesdrop on Americans.

Presumably, yes. But AGAIN... If he has the plenary authority to write any law he wants, without Congress, in the name of being president and commander in chief and because we are at war... He can write all of the laws he needs and NOT wait for Congress to renew the Patriot Act.
Now do you get it? If he can just "Executive Order" what he needs, he can "Executive Order" the Patriot Act, right?
