Blotham is apparently quite ignorant concerning the appointment of qualified people to posts. When the later Mayor Daley was being questioned by reporters about his appointments, one asked: But, Mayor, those people may be quilaifed but you only appoint your friends to those posts.

The Mayor replied: "What do you want me to do, appoint my enemies"?

Both Blotham and BBB seem to be blithely unaware of the workings of Political appointments. I suggest that they review the appointments made by Bill Clinton( with special reference to the scandalous "Travelgate" mess to discover how "professionals make the appointments. Hillary not only wanted the jobs for her friends, the Thomases, she constructed a bogus case, later blown out of the water in court, that the administrator held over from the Bush Administration was a criminal.

There has never been a bigger liar in the White House. His lies have led to the murder of thousands of innocent people in Iraq and Afghanistan not to mention the murder of well over 2000 of our own soldiers. Another 20,000 or so maimed, injured, blind, disfigured for life. And you are still making excuses for that fraud who has probably never won an election in his entire life and that includes the governorship of Texas!

Ticomaya- Posner's piece is indeed cogent. The problem is that those who need to read it will not do so. Posner is well known throughout the USA by thousands who are interested in learning about the law. His masterpiece, "Overcoming Law" is unmatched in modern legal writing.

A report by Congress's research arm concluded yesterday that the administration's justification for the warrantless eavesdropping authorized by President Bush conflicts with existing law and hinges on weak legal arguments.

The Congressional Research Service's report rebuts the central assertions made recently by Bush and Attorney General Alberto R. Gonzales about the president's authority to order secret intercepts of telephone and e-mail exchanges between people inside the United States and their contacts abroad.

The findings, the first nonpartisan assessment of the program's legality to date, prompted Democratic lawmakers and civil liberties advocates to repeat calls yesterday for Congress to conduct hearings on the monitoring program and attempt to halt it.

The 44-page report said that Bush probably cannot claim the broad presidential powers he has relied upon as authority to order the secret monitoring of calls made by U.S. citizens since the fall of 2001. Congress expressly intended for the government to seek warrants from a special Foreign Intelligence Surveillance Court before engaging in such surveillance when it passed legislation creating the court in 1978, the CRS report said.

The report also concluded that Bush's assertion that Congress authorized such eavesdropping to detect and fight terrorists does not appear to be supported by the special resolution that Congress approved after the Sept. 11, 2001, terrorist attacks, which focused on authorizing the president to use military force.

revel, I read that article in this morning's San Jose Merc, but didn't bother to post it, because it still shows doubt about the "legality" issues. The Supreme Court needs to chime in on this one.

Sure, it posts doubt on the "legality" issues. And, of course, the USSC needs to chime in.

And, I will quote the Assistant Attorney General, WHO WORKED FOR BILL CLINTON FROM 1994 TO 1997, Mr.John Schmidt, who opined that in his learned opinion, based on close work with the USSC and the Justice Department, the USSC WILL NOT SECOND GUESS THE PRESIDENT ON THIS ONE.

Those who are certain of what the courts will do have only to remember that Vice President Cheney was once pilloried for his contacts with energy leaders in meetings. The left wing went crazy and demanded that Cheney release the list of people who attended the meeting,. Cheney said he would not since it was necessary to get opinions from people without subjecting those people to unnecessary scrutiny.

GUESS WHAT!!! The court voted in favor of Cheney's position, as it will be in favor of President Bush's efforts to prevent radical Islamists from repeating 7/11 in any way, shape or form on our shores.
