COLUMBIA, S.C. (AP) — A White former police chief will have to spend a year under home detention but won’t have to serve any prison time in the 2011 shooting death of an unarmed Black man.

Prosecutors agreed Tuesday to drop a murder charge against 38-year-old Richard Combs, the former police chief of the small town of Eutawville, in exchange for his guilty plea to misconduct in office. The murder charge carried a penalty of 30 years to life.

Circuit Judge Edgar Dickson suspended a 10-year prison sentence for Combs as long as he completes his home detention and five years of probation.

Combs stood trial twice on the murder charge, but both cases ended with hung juries. Defense attorney Wally Fayssoux said Combs was ready to end a four-year ordeal.

“My client is financially and emotionally exhausted,” Fayssoux said.

Bailey’s family told the judge he was a good man who stayed out of trouble and was targeted for arrest by an officer who was on a power trip, which set the tragedy in motion.

“We have been on a mission of justice. We know the outcome of this trial will not help Walter. But perhaps it will help some other family, some other young man,” said Bailey’s sister, JoAnn Bailey-Lawton.

Eutawville suspended Combs after the shooting and dismissed him several months later. The town reached a $400,000 wrongful death settlement with Bailey’s family.

Combs shot Walter Bailey in May 2011 as he tried to arrest him on an obstruction of justice charge weeks after he argued about his daughter’s traffic ticket on the side of a highway. Eutawville is a town of 300 people about 50 miles southeast of Columbia.

Bailey came to Town Hall to discuss the ticket and Combs told him he was under arrest. Bailey stormed out and got in his pickup truck and Combs followed, authorities said.

Bailey was shot three times as he backed his truck out. Prosecutors said Combs was trying to arrest Bailey on a trumped up charge, was not threatened and could have stepped out of the way.

Combs testified he was leaning into Bailey’s pickup and had just seconds to react. They said he had no pepper spray or stun gun, which left him no option but his gun. He was the only officer in the town.

Combs had been a police officer for several jurisdictions for 10 years after serving time in the Marines. He won’t be a law officer again, Fayssoux said.

“He has to completely start over. He was branded a racist,” Fayssoux said after the hearing. “All of that wasn’t true.”

Combs’ guilty plea to the lesser charge was a good outcome because it punishes him for “a totality of poor judgment,” Solicitor David Pascoe said.

The jury in the first case voted 9-3 to convict Combs. The jury in the second case voted 8-4 to convict, with four jurors wanting to convict Combs of murder, four wanting to convict him of voluntary manslaughter and four who thought he was not guilty, Pascoe said in a hearing at the Orangeburg County courthouse.

Fayssoux said he thought the juries were leaning even closer to an acquittal for Combs, but didn’t give numbers.

Combs was one of four South Carolina police officers charged with felonies for on-duty shootings in the past year. The officers in the other three cases are awaiting trials.

Seriously, how many dead bodies are there in America this year from violent crimes? How many are from cops? These questions are for anyone here to answer me or ask yourselves. Why is the small number of police shootings the only thing you want to squawk about? Who else besides our boys in blue are doing anything about our real problems with real criminals?

Though certain groups are clearly unsettlingly committed to perpetuating the myth of a "war on cops" instigated by the growing #BlackLivesMatter movement, the actual figures simply do not support any version of this alternate reality. Not only has the number of police officers killed by gunfire dropped this year by a reported 13 percent, but the actual likelihood of an officer being shot and killed is profoundly low, especially when compared with an issue actually impacting the field of law enforcement: suicide.

126 police officers committed suicide in 2013, the last year such statistics are available on public record. As noted by the Daily Kos, this number is overwhelmingly higher than the 43 officers projected to be killed in the line of duty in 2015. Some experts argue that the suicide rate would potentially be much higher, theorizing that many suicides are likely misreported as accidental deaths:

"Suicides can happen in any profession, but they occur 1.5 times more frequently in law enforcement compared to the general population. Quite truthfully, the actual rate is probably higher as law enforcement suicides are more likely to be underreported or misclassified as accidental deaths. This misclassification usually occurs to protect the family, other survivors, or the agency from the stigma of suicide."

With this "war on cops" preposterousness continually debunked, perhaps society can return its focus to an issue with actual urgency and statistical validity: police brutality.

It is taken as a given and we have this little problem in the US that black on black murder rate is so high that unlike any other sub group in the US the leading cause of deaths of young black males are other young black males.

All other groups murders are at least the third cause of deaths behind accidents and diseases.

What numbers did I make up from the top of my head, as I gave links to the Chicago murders rate for blacks in other postings and anyone can confirm that that nationwide the leading causes of deaths for black young men is homicide by way of the CDC website.

So what numbers are you questioning ?

It is a given for most people. Some of us like to forget that when it's convenient though. Your looking at a super small portion of cops and blaming them for a super small portion of homicides in the U.S. and making it a huge thing. Like saying a plumber happens to murder someone and pretend that is a nation wide epidemic of plumber brutality. You are not giving an accurate representation of what really happens, you just put a couple people under a microscope and pretend its the entire US police force and forget about what they are protecting us from and who they serve altogether. It's a form of stereotyping, and just as ignorant as any other form of stereotyping.

Yes indeed cops shooting anyone is not what driving the nationwide murder rate with special note of when it come to young black males, who are far more in the need of police protection then any other group in US society.

Seems so very strange that thousands of deaths of black young men at the hand of other black young men does not cause any out cry but a few police shootings does.

Explain this. Cops deaths have dropped dramatically. Unarmed black youth shot by cops are growing dramatically.

How can anyone explain the willingness of late of unarmed black young men to get into fights with police officers such as "poor" Michael Brown trying to seized officer Wilson gun?

In any case, police shootings are rare and a tiny tiny faction of the deaths of black young men at the hands of other black young men.

Strange that black lives matter only if the killers are not other blacks.

You can blame your support groups for that. Unarmed does not mean cooperative, and fighting police is becoming glorified so more people are doing it. In most situations cops DO NOT KNOW if someone is armed or not, which is why they ask the suspect to put their hands up. If the suspect is not cooperative than the cop has to use his best judgment to figure if his life is in danger and what level of force to use. As more situations arise where people resist police, more situations will happen where the police will have to guess if they are in danger and have to shoot. This is another reason why we should stop glorifying our criminals who resist arrest and stop making this something it isn't and doesn't need to be. We DO NOT have a police brutality problem, we have VERY FEW police who are thugs, some get caught some don't. To me these cops go in the same category as every other murdering thug in the U.S. Sometimes your thug is a drug dealer, sometimes its a plumber, sometimes its an big wig at a big corporation, and sometimes it's a cop. The problem is THUG, not plumber, dealer, big wig, cop, or (insert job title here).

When someone is dumb enough to fight the police there is always repeat always at least one firearm at the site, IE the cop firearm.

Moreover, so far in 2014, it has been confirmed that Johnson City (New York) Police Officer David Smith was murdered in March with his own weapon. Smith had served in the police department for over 18 years.

In Smith’s case, according to the Officers Down Memorial Page report, before he was able to exit his patrol car or radio for help, the alleged assailant was able to disarm Officer Smith and shoot him while he was still in the patrol car.

Sure I do and it is not realty that the gangs and gangs murders in Chicago for example is not many many many times more likely to end a young black man life then the Chicago police department.

Hell that military doctors are not placed into Washington DC hospitals to learn how to deal with gun shots wounds cause for the most part by black gangs warfare.

Once more black lives seems not to matter if it other blacks doing the killing for some strange reason.
