I wouldn't pay a lot of heed to political talking points (from either party).
The Republicans had (and still have) the right to try to repeal this if they feel like it.
I think they will fail in that effort, but there is nothing illegitimate in them trying.

Probably right after 2016.
After Obama's gun control debacle, he's not going to achieve much legislation in his second term. And after four years of a do-nothing presidency, the voters will be more than ready to switch which party controls the White House.
