Would like to know how I stand in a relationship breakdown. I started off with a house all paid for and now have a business i can't sell, he has the car which is in my name and he is away working. We owe a lot of money on another house which we are paying off. My previous relationship cost me a lot of money and i'm frightened i will lose everything if i split with my defacto. Our business which i am trying to keep going is not going well and i can't seem to get anyone interested to buy the hotel as its not making money. I put my super into this business so what do i do? sell it for almost nothing and still we have the mortgage on a house to pay off which i presume if i leave i will have to do (I'm in my 60's) and have never had so much worry and now suffering with depression. What rights does a woman have when she started off with a house and he nothing (he was renting). We hav ebeen together for 10 years.

You need a lawyer.

Given the length of your relationship, there are states where you might be considered to have a common law marriage, but that depends on a number of factors. Even if there is no common law marriage, things like the type of business (e. g. corporation, partnership, subchapter S corporation, etc.) would define a lot of what you're asking.

So, I repeat, you need a lawyer to help sort out this tangle.

Are you married? I think you should probably get a lawyer to get a better understanding of what options you have. Don't go in blind to a situatin like this or you could get a heart attack.

Contact Legal Aid or the office of legal services (names vary, depending upon the state you live in). This stuff is easy to Google. http://www.probono.net/
