These laws/regulations/whatever have gotten so far out of hand it's becoming silly. I suspect that any of these prohibitions that are actually laws (city ordinances, whetever) will eventually be overthrown in the courts when some brave soul dares bring suit against the governmental unit that passed such a bogus law. As far as conditions of lease, that's another matter. A lessor has the right to set rules for lessees. The only way to fight that is for enough people to refuse to sign a lease in any building where such rules obtain and let the units stand empty.

The no smoking in bars law in NYC, Calif. and elsewhere is one of the dumbest examples of well-intentioned paranoia I've run across yet.

Alright mainly, any apartment owner does not want their tenants to smoke in their apartments just due to the fact it stinks up the whole apartment. Secondly, when new tenants are wanting to come in, if the apartment smells like smoke no matter how great it looks, they are most likely not going to take the apartment because they feel like the apartment is "tainted."

I gather they will change the later some time soon but can't due to some form of legislation.

Hotels, apartments, Motels, Restauarants, you can't smoke full stop here in Aussie Land.. There is no longer a choice of "smoking or non smoking".

I think it's a good thing and I am a smoker ahhhhh who would love to quit one day, just not yet.

I used to smoke in my house, but now we've moved, I refuse to.

I get that passive smoking causes problems and whilst I may be stupid enough to kill myself, no point killing anyone else.

Well unless they shirt me off or something...

Mitchells & Butlers, the largest managed group, which includes the Harvester, Toby Carvery and O'Neill's chains, claims to sell more turkey than Tesco and JD Wetherspoon sells more than 250,000 breakfasts and more Lavazza coffee than any other retailer.

It's not just the smoking ban, supermarket chains are selling discount beer at less than cost. The price of a cheap discount tinned pint can be up to ten times cheaper than one in a pub. Solitary drinking isn't good.

Maybe the laws about the anti-smoking are really contradictory, but it wanted to protect the health of the majority of the people, in essence, want people to quit smoking.

Government does not have jurisdiction
to annoy the citizens into doing whatever government wants.

This is weird but yeah why not smoking isnt good for health why put trash on your body if you think health is wealth

Thankfully my house is not rented...when I bring non smoking friends I just peak another room when I feel the need for a cigarette...invasive policy's like that always start with plausible good arguments and always end in loss of liberty and abuse...I wonder how the world will go in 50 years time...people are dumb and yes they love to impose on others private matters...they just can't help it...sooner rather then later they are trapped and victim of the same acts...today is the cigarettes, tomorrow alcohol, later on junk food in the freezer...******* dumb people !

that its a bad idea to suck dirt into your lungs,
but its a personal decision. The answer to your question
of "why not" is absence of jurisdiction; America is supposed to be the Land of the Free.
