Well I'm still here for now but not sure for how long, my aunt is not my legal guardian. I'm not sure what it all that means yet, my aunt only told me she need an attorney but can't afford one.

Travis send me a message with the county and state you live in, might be able to find your aunt some legal aid. Some organizations in the GLBT community will offer free legal assistance if you qualify.

That would be great if they could help Travis' aunt.

Travis, my guess is that your mom doesn't want to give up parental rights due to the financial assistance she receives for you. Having your aunt declared legal guardian would translate into her receiving the assistance payments instead of your mother.

DUH, and with no documented abuse it is not likely that anyone can make her.

Can you get a legal aid lawyer yourself and try for emancipation? I don't know what the laws are where you are, but you might want to try and get this done by yourself. Perhaps talk to a school counselor, they maybe able to hook you up.. Good luck, regardless of the outcome.

Almost none, which is why it is not a viable option. Travis might have some shot at getting what he wants if he can prove abuse, but it does not sound like he can. I remain convinced that sometime soon he will decide to strike out on his own, will decide that being on the streets is a better option than is remaining in his home situation. What he needs is an advocate in the family who can put his mother in her place, get her to back down, but it does not appear that he has that. Trying to get the state to help is very long odds, they have a much chance of putting him in an even worse situation than he is in now as they do in offering help.

Yes she is and I am staying with my aunt for good. My mom couldn't fight and signed the paperwork for me to stay here, the lawyer me aunt found gave her no choice.
