A Great Victory For Whales!!!



Fantastic news! A federal court in California has just imposed
the strongest-ever protections for whales against an onslaught
of military sonar.

The new controls are the result of an NRDC lawsuit that demanded
the Navy rein in its deadly sonar before beginning two years of
maneuvers near the Channel Islands -- one of the world's most
sensitive environments and home to five endangered species of
whales.

The Navy itself estimates that the booming sonar would harass or
harm marine mammals some 170,000 times -- and cause permanent
injury in more than 400 cases.

U.S. District Judge Florence-Marie Cooper said the Navy's
existing plan for protecting marine mammals was "grossly
inadequate." And she has ordered the Navy to put a series of
precautionary measures in place -- many of them recommended by
NRDC -- that will go a long way toward protecting whales from
needless injury and death.

For starters, the Navy will not be permitted to use its
dangerous mid-frequency sonar within 12 miles of the California
coast, a zone that is heavily used by migrating whales and
dolphins. Sonar will also be banned in the Catalina Basin, an
underwater canyon with a high density of whales.

The Navy will also have to monitor for marine mammals -- from
the ship and from the air -- both before and during its sonar
exercises. If any marine mammals are spotted within 2200 yards
of the ship, the Navy will have to shut down its sonar.

These safeguards represent a giant leap forward in our
decade-long campaign to make sure that whales don't have to die
for the sake of military practice.

Needless to say, this fight is far from over and many more court
battles lay ahead.

But case by case, we are accomplishing what many thought
impossible: forcing the Navy to obey our environmental laws and
stop its needless killing of whales -- and all without
compromising military readiness.

Forest Service drops appeal on rules
Activists glad administration 'has thrown in the towel'...

WASHINGTON - The Bush administration has dropped its appeal of a 2007 court decision that had overturned new management rules for 191 million acres of national forests. Opponents to the rules had argued they weakened protection for wildlife and the environment to the benefit of the timber industry.

The Justice Department notified the 9th U.S. Circuit Court of Appeals this week that it was withdrawing its appeal, saying that the other parties, including the timber industry, would do likewise.

"We are glad the Bush administration has thrown in the towel," said Trent Orr, an attorney for Earthjustice, one of the environmental advocacy groups that had challenged the new forest management rules in court.

The court papers, filed Monday, were made available to reporters Tuesday by Earthjustice and the Western Environmental Law Center, both of which were involved in the case.

Last March, a federal district court in California found that the U.S. Forest Service had bypassed required environmental reviews and provisions under the Endangered Species Act in its overhaul of the management rules, including changes in logging limits, for its national forests.

U.S. District Judge Phyllis Hamilton, acting on a lawsuit filed by environmentalists, prohibited the further implementation of the revised rules which were issued in January, 2005.

The lawsuit argued that the new forest management plan illegally eased logging restrictions and removed a number of mandatory protections that had been in the previous management regulations, while also curtailing public participation in developing management plans.

"The good news is they've dropped the appeal," said Orr in a telephone interview. But he said that doesn't mean the issue is put to rest.

Last August, the U.S. Forest Service said it was developing revised rules that it hoped would pass legal scrutiny.

"They're just kind of doing the same thing over again. I suspect the court won't be any more friendly to this version," said Orr, predicting further lawsuits.

A spokesman for the Forest Service did not return a phone call seeking comment.

Bush is being advised to do these type things to preserve his legacy during his lame duck last year in office - I do not think he is smart enough to do it himself.

He, and his three brothers, have put their hands in every taxpayers pocket and stolen our money. I don't know what Papa Bush has in mind for his third brother - that no one has heard of.

W is the first born son of Papa Bush. Then John (nicknamed JEB) (stole two billion dollars of taxpayers money and the federal investigators said he was too stupid to file charges against. He got away with 4.5 million dollars in buildings), then Neil, (who stole two billion taxpayers dollars in Colorado - got away with 250 million), then the unknown one - Marvin. The youngest brother of our president who - I betcha - nobody knows about or has ever heard of.

It's our children who will have to pay for it all. As well as our grandchildren. And, in this case maybe our greatgrandchildren.

It's Skull and Bones - all over again.

And, nobody can really care, because money and position of power talks. That's 1% or less of our population - controlling all the rest.

Dan, gwb's legacy of the worst president in the history of the United States will be forever etched in stone.

Reason why he's 'throwning in the towel' is the fact he can't intimidate federal prosecutors any longer, and federal judges are more than willing to reverse every lousy enviornmental law the administration enacted.

The Bush family influence, imo, will end the second gwb's term does.
