Maybe I've got the number wrong, but it's the one about specifying that what is not covered elsewhere in the Constitution is defined there as belonging to the people or to the states. I don't know why this Amendment is largely ignored. Every nut after a special deal should salivate over the potential of this Amendment.

Actually this is what the Judge in Alabama is trying to use to justify the Tem Commandments Monument.

Of course, Alabama and other Southern States tried to use this toi justify slavera and segregation.

Any wonder the South is the heart of Bush's "Flyover Country"

You are referring to the 10th Amendment

There have been plenty of 10th Amendment appeals to the USSC. Most of them have lost in recent years because the Congress got smart and started phrasing laws based on authority they ARE granted in the Constitution.

Congress had no authority to legislate a 55 MPH national speed limit nor the recent requirement that libraries filter Internet access but they DO have the authority to control how Federal funds are spent so they twisted the arms of the states by passing laws the prevented the states from getting federal funds if they didn't play along. Those are both examples a Federal end-runs around the 10th Amendment but there are plenty more.

Seems to me that 'to the people' is pretty loose, interpretation wise. Bit like 'the pursuit of happiness', looks good on paper only.
