Blacks aren't judging Nifong
Community leaders await next step after dropping of charges

While scrutiny of the Durham district attorney's handling of the Duke lacrosse case intensifies, key members of the county's influential black community still back the prosecutor, though cautiously.

The district attorney, Mike Nifong, dropped rape charges Friday against former players David Evans, Collin Finnerty and Reade Seligmann after the 28-year-old accuser said she was unsure whether the players had penetrated her.

The move spurred outrage against the district attorney for continuing a case many legal experts say has completely unraveled.

But several members of Durham County's African American community said they believe Nifong is keeping his word to fully investigate.

"It's not going in our favor at this point," said Durham County commissioner Michael Page, adding that he felt Nifong would continue only if he had evidence of something occurring that deserved punishment.

"The question is what and who did it."

Cora Cole-McFadden, Durham's mayor pro tem, said she thinks Nifong is doing what he believes is right.

"I'd rather not be judgmental," she said. "I'm certainly anxious to see how this legal process is going to work."

The Rev. William Barber, president of the state chapter of the NAACP, urged patience.

"This is not a sound-bite case," Barber said. "We do not want a rush to judgment or a delay of justice."

The support of the African American community has been key for Nifong, who has received strong support among black voters.

More than a third of registered voters in Durham County are African American.

The accuser, an N.C. Central University student hired to perform as a stripper at a team party in March, has long said that three lacrosse team members raped her in a bathroom. On Thursday, however, she told an investigator that she was no longer sure that a penis was the body part that penetrated her.

The defendants still face at least 20 years in prison if convicted on the remaining charges of first-degree sexual offense and one count of kidnapping.

Nifong hasn't returned requests for comment. He told The New York Times on Thursday that the accuser is determined to continue. He said he will prosecute the players unless "she tells me these are not the right guys."

The players' lawyers and family have demanded the case be dropped based on lack of DNA evidence and questions about the accuser's credibility.

"It's hard to figure out how this DA is playing this," said Kevin Finnerty, father of Collin Finnerty. "It's pretty obvious to us that from the outset this man has been using this case for his own personal and political gain."

U.S. Rep. Walter Jones, R-N.C., and state Rep. Stephen LaRoque, a Lenoir County Republican, among others, have called for Nifong to be investigated for possible prosecutorial misconduct.

The Rev. Frederick Davis, pastor of First Calvary Baptist in Durham, said he is withholding judgment on Nifong until the case is over. He expressed concern of the media storm is having on the accuser stating he hopes she is receiving the proper counseling and family support.

"My prayers are with her," he said.

I was sort of hoping to see what "Snood" here might have to say on this one, i.e. what he figured anybody in Durham NC might hope to gain by any of this....

Im probably in a minority of rednecks in viewing this as a demokkkrat problem rather than a black problem, and am sticking with my opinion that 90% of the problems which blacks experience living in America would evaporate within five years of the demokkkrat party being outlawed and banned. In this particular case, you seem to have a bunch of dufeless people whove been convinced that the world owes them something and a shit4brains district attorney who has some sort of a plan to become the next Janet Reno or Scott Harshbarger, and the two clearly feed on one another; only problem is that Janet Renos witchcraft trials were in the age just prior to the present internet age and nobody would get away with anything like that now.

But its not like Nifong is the only a$$hole or lunatic DA in the land. DA is all too often a stepping stone on the road to things like mayor or governor and that road is occasionally paved with the suffering of innocents, and that process seems to particularly thrive in situations in which oldfashioned demokkkrat machine politics prevail, as in the cases of Reno or Harshbarger. My own feeling is that we need to get rid of the adversarial system of justice and go to an inquisitorial system such as you see in European countries in which the common incentive of all parties involved is to arrive at truth and reality.

There ARE precedents for outlawing and-or banning rogue or criminal political organizations: the tong societies, the KKKlan, the nazi and communist parties, the society for the restoration of the Hohenzollern monarchy etc. etc. The demokkkrat party in my view belongs on that same list.

I have the view that the republican party belongs in that list. But I'm guessing that being a conservative, you also believe that your views and opinions are more valid than mine.

One fairly obvious difference, a republican pol caught in any sort of provable criminality or even any sort of provable ethical conflict can assume his career is over and the party itself sees to that. Demokkkrats go to the wall to protect thier own no matter what, as we observe in the cases of SlicKKK KKKlintler and William Jefferson, for instance.

Actually, in the case of Nifong, there is a charitable assumption one could make, i.e. that the dude is basically crazy and needs to be in some sort of a psych lockup situation.

There is no such charitable assumption for the elected officials and voters of Durham NC. The only safe assumption is that they want vengeance for perceived wrongs of the past and are willing to use any sort of political or legal powers which they fall into to get it. There is similarly no charitable assumption to be made for the president and management echelon of Duck University. The only safe assumption is that they were willing to throw a coach and several students under a train for the sake of political correctness, with no thought as to justice or facts or anything like that.

Given all of that, I cannot see how a thoughtful parent could allow a child to remain there as a student. If Id been a student at Duck prior to this BS, Id be long gone, and if I had a kid there as a student, he or she would be long gone.

This one is amazing. It's the cleanest shot anybody has ever had at one of these lunatic DAs, exactly as if Janet Reno had tried to do her witchcraft trial BS in the internet age, and it seems pretty clear at this point that Nifong is going down. If there's any justice in the world the city of Durham NC will go down with him and end up as a post office address instead of a city.
