He certainly doesn't have the authority of the United States Government, but he's no private citizen either. I agree that he's out of line, but his Senatorial status prevents the Logan Act from applying to him.
I think you read it wrong. It says:
Any citizen of the United States, wherever he may be, who, without authority of the United States, directly or indirectly commences or carries on any correspondence or intercourse with any foreign government or any officer or agent thereof, with intent to influence the measures or conduct of any foreign government or of any officer or agent thereof, in relation to any disputes or controversies with the United States, or to defeat the measures of the United States, shall be fined under this title or imprisoned not more than three years, or both.
This section shall not abridge the right of a citizen to apply himself, or his agent, to any foreign government, or the agents thereof, for redress of any injury which he may have sustained from such government or any of its agents or subjects.
So if Kerry does not have authority granted to him by those that have the responsibility to make policy, then he is acting essentially as a private citizen. The act says "Any citizen" which he is, and he carries on talks for which he lacks authority, I think he is violating the act.

No one has ever been convicted under the act, signed into law in 1799, and only one person has ever even been indicted under it. Many legal scholars believe that act is unconstitutional.

I guess our government has to imprison everybody, or at least the majority, for voting against president Bush during the last election. Build that fence around the US!
We don't inprison some of the most dangerous to the US, apparently. Kerry is still free.
