The Republicans, with NUMERICAL superiority in Congress, can pass anything their leadership deems neccessary.

Sorry, but the continual Blame-game passing of the buck and deferral of "personal responsibility"(from the Repubs to the Dems) tends to make you appear as a partisan shill...
( well, that and every other position you take, on any issue in contention).
"Lash" would be a suitable nick for a Party "whip".

Call your Senator, Democrat or Republican, and tell them that you need the caps reinstated.

If your Assembly representative is Republican, thank them for your vote and urge their continued support.

If your Assembly representative is a Democrat tell them that you do not want or need subsidies, and the only long term fix to the problem is the Senate caps.

The NJ Senate. Appears to be a pattern--much like the national parties...

Senators reject tort reform again
Doctors warn that the vote will hurt patients' access to physicians.

The third time wasn't the charm for medical liability reform.

The U.S. Senate on April 7 rejected an attempt to cap noneconomic damages at $250,000 in medical malpractice lawsuits involving emergency physicians and obstetrician-gynecologists. Physicians in these two specialties are among those hit hardest by rising liability insurance premiums.

In a 49-48 vote, the bill fell short of the 60 votes needed to stop a filibuster led by Democrats.

This is the third bill brought forward this session by Republican lawmakers who support physicians' efforts to control surging liability insurance costs through a cap on pain-and-suffering awards.

Last year, the Senate voted against a $250,000 cap in all medical malpractice cases, and earlier this year, there weren't enough votes to stop a filibuster on a bill for ob-gyns.

Tort reform proponents are disappointed but remain optimistic.

"In the end, the voice of the people will break through the trial lawyers' smokescreens," said American Medical Association Trustee J. Edward Hill, MD.

"The strides our country has made in reducing maternal and infant mortality through good prenatal care are being jeopardized," the American College of Obstetricians and Gynecologists said in a statement.

More than half of the emergency physicians who took part in a survey last fall said there's a shortage of on-call specialists.

"Our nation's broken medical liability system is causing some patients to be transported out of state for medical care, which can mean life or death when time is of the essence," said American College of Emergency Physicians President J. Brian Hancock, MD.

Democrats who oppose caps acknowledged that physicians and patients face a real problem. But they and trial lawyers said noneconomic damage caps are unfair to patients and won't stop insurance rate hikes.

"Let's make the practice of medicine safer," said Sen. Dick Durbin (D, Ill.). "Let's reduce the number of frivolous lawsuits. ... Let's hold insurance companies responsible for overcharging."

Laycock further states that there is no difference between insurance premiums in states that have caps, and in states that don't have caps.

This is the simple piece of logic that shoots a hole right in the whole republican strategy on this issue.

I challenge anyone to refute the argument that while medical malpractice is an important issue, and should be regulated, it is NOT responsible for the rise in malpractice insurance!!! The whole thing is a red herring.

I've seen that bilge by Dems--1%... another lie. They look bad siding with trial lawyers over ...us, so they constructed that lie.

Lawsuits have pushed healthcare out of the reach of most people--caused doctors to order thousands of dollars of unnecessary--or unwarranted tests--to avoid lawsuits. You know it has caused an enormous rise in healthcare costs.

The Dems CAN'T agree with this, because they are protecting the Lawyers for cash. If it weren't for the Lawyers', Unions', Teachers' lobbies--the Dems wouldn't exist. They'd protect them no matter what they do--and how much that hurts us.

To correct a few facts: Source

Bush implied U.S. authorities shut the factory, saying, "We took the right action and didn't allow contaminated medicine into our country," when English authorities shut the Chiron plant.

In fact, according to the Institute of Medicine, a division of the National Academy of Sciences, the frequent vaccine shortages result from two factors: Vaccines aren't profitable, and drug companies keep merging.
