Lawyer Files Motion To Keep ‘Permanently Comatose’ Toddler On Life Support
OTTAWA — The Supreme Court of Canada has received a motion for a stay Thursday morning from the lawyer of an Alberta mother whose comatose infant daughter was just ordered off life support by the Alberta Court of Appeal – against the wishes of the parents who allegedly starved her.
The court confirmed Thursday that they received the motion around 9:30 a.m. ET, but said it was not yet accessible to the public. If the top court grants the stay, it would prevent “Baby M.” from being taken off life support until the court makes a final decision.
On Wednesday, the Alberta Court of Appeal ordered that the “permanently comatose” two-and-a-half-year-old girl be taken off life support, dismissing an appeal from her parents.
“The sanctity of human life is one of the core values of our society and our legal system. But life is not without end,” Justice Frans Slatter said in the judgment.
“The medical condition of M. is such that the decision to provide only palliative care would be the same, whether the parents were said to be responsible for her injuries or not. Upon review, we cannot see any error of principle in that decision which would warrant interference by this Court.”
Baby M.’s parents, who cannot be named under a publication ban, have been charged with aggravated assault, criminal negligence causing bodily harm and failing to provide the necessities of life after the girl was found in late May injured, starved and in cardiac arrest. “The parents have been charged with aggravated assault and other related offences, and if M. dies their jeopardy may be enhanced,” the judgment noted.
Baby M. has been in a coma in the pediatric intensive care unit at the Stollery Children’s Hospital in Edmonton. Her doctors unanimously agree that her condition is irreversible, according to court documents.
