Lincoln was not the president when Florida, Alabama and South Carolina attacked Federal installations. Quite apart from that, the Confederacy was a violation of the constitution. The first paragraph of Article One, Section Ten, reads, in its entirety:
No State shall enter into any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; coin Money; emit Bills of Credit; make any Thing but gold and silver Coin a Tender in Payment of Debts; pass any Bill of Attainder, ex post facto Law, or Law impairing the Obligation of Contracts, or grant any Title of Nobility.
Firing heavy artillery at a United States installation is not a technicality. Attempt to seize a Federal installation, defended by United States troops, is not a technicality. I suppose in 1941 you think we should have told the Empire of Japan "Oops, sorry, here, you can have the Hawaiian islands, just let us evacuate our forces, and we can negotiate compensation down the road."
