Isn't "instutionalized racism" what is being built here though? If businesses are allowed to decide who they will hire based on race, age, etc.. then they are institutionalizing the policies.

Nothing prevents any company from catering to whatever niche they want. But they can't discriminate in the process of doing that. Federal labor law says that once you exceed a set number of employees you loose that "right" whether the company is private or not. If I remember correctly the magic number is 100 employees. (A&F isn't a private company btw. They are publicly traded which makes them a non-government public corportaion.)
