Whose Divorce Laws Do We Follow?

We were married in Nevada in 1975, but we always lived in New York. No wedding ceremony was ever performed in New York. Would our separation and divorce be governed by the laws of the state of Nevada or New York?

They are governed by the state you live in, no matter where you got married.

The state you file your divorce in must have jurisdiction, first of all. New York clearly has jurisdiction, because you meet whatever residency requirement they have.

If you've never lived in Nevada, they don't have jurisdiction.

So, the quick answer, as between those two states, is New York.

It doesn't matter that you were not married in New York.
