I don't think 'by' is the correct preposition. I think it should be 'on the telephone'. Am I right?

I think "on the" is better for this particular sentence.
However,
I ordered a book by telephone.
I enquired about plane tickets over the telephone.
... are all OK.
We can communicate by email.
We can communicate by voice mail.
We can respond by telephone.
"by telephone" would indicate the method of communication.
I muchly prefer:
"Ka Bopha did not set out to fatally beat her son," Kay Noul said, "by telephone".
