Hi I was just wondering if work violation notices stay on your record. Like If you wanted to get a different job and you have one violation notice from your old job will that limit your chances of getting a new job? If they do stay on your record how long would that be?

Welcome to A2K.

What sort of work violation are you talking about in what sort of job?

If you are a doctor convicted in one little malpractice suit where the patient died, that information is on your record forever.

If you are a dishwasher who knocked a tray of bar glasses off the table and on to the floor, this act of destruction will eventually be forgotten.

Your situation is probably somewhere between these extremes.

If you apply for a new job, are you going to be using your old employer for a reference?

Well i work at a fast food restaurant and i stole an ice cream and i was written up a violation notice Embarrassed i was already thinking about quitting before this incident happened but now i really want to quit because I've realized i really don't like working there and the people are just bleh to the max. well in terms of applying for a new job, up until now I have had a good relationship with the manager that actually employed me and a different manager wrote me up. The manager that actually wrote me up seriously hates me. So should i use my old employer as a reference? I am sooo confused I've never been written up before i don't know what to do. is what i did minor or major?will it be on my record? Confused

This is not a cut&dried, one-answer situation.

When you fill in an application form you are usually asked for both personal and professional references.

At your present job you have two managers: One Friendly, One Unfriendly (with some reason to be so).

Would the Friendly Manager be willing to write a personal reference?

The job application form will ask for your work history. You will have to list your present job. Stealing the ice cream was not a good idea, but you were warned rather than fired indicating that even the Unfriendly Manager feels the offense was minor.

The theft will be a part of your record forever with your present employer. If you give your present employer as a professional reference, the Unfriendly Manager may or may not mention the theft.

How long ago did you steal the ice cream? What has your work record been since then? Time and a good performance on the job can mitigate--but not erase-- your stupid theft.

You don't like working in fast food. What do you want to do?

well it was recently like 2 days ago. My work record there has been very good. I want to go work at a clothing store for my new job. but i still have to go hand in my resume. I talked to the restaurant manager the one who is nice and he didn't really make it out to a really big deal. Although, I think if I decide to apply for the new job. I don't think the friendly manager would put me down if they were a reference. It is the unfriendly manager that I am worried about.

Consider using the Friendly Manager as a personal reference--or give his name as the person to contact at the fast food restaurant.

Be sure you ask his permission, first.

You might ask him what sort of reference he would be comfortable giving you. If he says he'd have to mention the theft, either resign yourself to fast food for another six months or so or applying for the new job with no work history.

Unfortunately a sticky-fingered employee is not a good risk.

Wow so you can actually just put down that you have no work experience if you no references or they are bad? wow I totally did not know that.

Thank you very much for everything, I think I am going to go ask my manager next time I go to work if they will be my reference and what would they say. Thanks a lot for your help.
