Appeals court backs Bush on wiretaps

WASHINGTON (AP) ?- A federal appeals court sided with the Bush administration Friday on an electronic surveillance issue, making it easier to tap into Internet phone calls and broadband transmissions.
The court ruled 2-1 in favor of the Federal Communications Commission, which says equipment using the new technologies must be able to accommodate police wiretaps under the 1994 Communications Assistance for Law Enforcement Act, known as CALEA.



So,now we have a federal court siding with the admin.
Anybody wanna bet that this goes to the USSC?

I didn't read the statute in question, didn't read the case so don't know what a fair application of the law to the case would look like. But considering who appointed the judges on the appeals court, and who appointed the judges on the supreme court, I believe the Supreme Court would side with the agency.

Do you realize, mysteryman, that the issue here is wiretaps with a court warrant? It isn't what we disagreed about in the FISA / NSA / warrantless wiretapping threads. Neither Debra, nor Cycloptichorn, nor parados, nor I dispute that the Feds can wiretap with a warrant.

Like Thomas, I haven't read the statute or court decision.

Was just going to comment that of course the new technologies would need to comply with police ability to wiretap, with a warrant, just like they can with regular phones.

Sounds like they are just updating the statute to match todays technology. That would be expected.
