I didn't read the statute in question, didn't read the case so don't know what a fair application of the law to the case would look like. But considering who appointed the judges on the appeals court, and who appointed the judges on the supreme court, I believe the Supreme Court would side with the agency.
Do you realize, mysteryman, that the issue here is wiretaps with a court warrant? It isn't what we disagreed about in the FISA / NSA / warrantless wiretapping threads. Neither Debra, nor Cycloptichorn, nor parados, nor I dispute that the Feds can wiretap
with a warrant.
