Can we remove "in" from "The first in from the top" without altering its meaning?

Context:

Sir, I’d like to direct your attention to the stack of documents in the folder I just handed you. The first in from the top is entitled “Operation Northwoods”, a declassified Pentagon plan to stage terror attacks on US soil, to be blamed on Cuba as a pretext for war.

Yes. It's an American phrase, I suppose, and I would not use it like that.

But yes, in answer to your question.

I'd probably say
1. The document on the top (the first)
2. The second from the top....
and so on.

I like "the document on the top," as fluent as a cool breeze.

Yeah, you could remove "in," and it's really better that way. But most people would just say "second from the top," to begin with, probably. If not, they would probably say "down" from the top, not "in."

Edit: I didn't even scroll down to see that you had already got an answer. This post just suddenly appeared on my screen, for some reason, and I thought it was new.
