Any event that would legally justify depriving people of their rights is already part of the system.
And in fact the Obama Administration is criminally abusing the background check system by adding people who are still legally entitled to have guns.

It is unclear whether you refer to gun shows alone, or to all private sales.
As far as gun shows go, it is necessary to allow people to buy guns without background checks because of the way the Obama Administration is criminally abusing the background check system (as described above).
Private sales that do not involve gun shows are intentionally outside the background check system, because including them in the background check system would enable any American to carry out background checks on unlimited numbers of other Americans -- a massive invasion of privacy.
