If juries would limit their decisions to information proven at trial, we would never have to worry about 'whether or not someone could get a fair trial'.

Do you think an American jury could possibly be partial in regards to someone as well known as Osama bin Laden ?
I'd have to say no. They can't even get lawyers.
Osama has been seen on tape, taking responsibility for 911 and plenty of other stuff.
As this would surely be admitted as proof--he could get a fair trial--and be found guilty, as the evidence would prove.
Who can't get a lawyer? Moussaoui had one.
In the event a terrorist was going on trial here in the States, the ACLU would see to it that he had a top-notch defense team and the State would be paying close attention to the rules. I'd say he's one hundred times more likely to get a fair trial than your average, poor, black drug offender.
You asked if an accused terrorist could get a fair trial in the US.
I think you're changing your topic, sorta.
If they are in the US Justice system, I don't think people would be out for blood, and ignore their duty as a jury to consider the evidence presented.
If you are asking if the Gitmo detainees will get a fair trial and if it will be in the US judicial system or not, I think that's a different question. They haven't been processed into the US judicial system--and I don't know if they will be.
They may not be in the US justice system but the US is detaining them.

Not really. You can't hold them in limbo forever. Eventually someone has to make a decision what to do with them. Charge them with something or let them go.

Actually--I agree it's past time to start charging and adjudicating. I seem to think I've seen reports that this is beginning, but I'm not positive.
