HAs the NM sun been good for you? If you agree that there was no crime then it isnt even needed. Its the law that is demanding that charges be filed in this matter.
Im merely stating the "goin in" conditions afforded the Accused (whosomever that may include).

Maybe an assessment for time and materials, just as if they were using the govt services. If I ever brek down on the seas, Im given an assessment for services and a tow bill by the coast gurad whose waters Im in and their approved towing contractor.


As far as the "reality show" fever, I exist in a constant state of amazement at the rating successes and the economic returns (due to their low cost) for reality shows. They are generally contrived, controlled, vapid, and manipulative. Other than that, they are healthy entertainment for our larvae to watch.

Call the aliens to take him away in their space craft, and prevent him from telling anyone about the incident. Perhaps a shock collar when he tries to describe the experience?

Seriously, though, I am concerned for his kids' welfare. Encouraging his kids to lie, to vomit on command, and to pursue stardom on a reality show, doesn't exactly win him "Parent of the Year" honors in my book.

I knew nothing of any commands to vomit.
A victim of any such commands might well sue the abuser,
if he deems the damages to have been significant.

Michael Jackson deemed them significant, when he was the victim.

One problem here is that actions was being consider that would had place human life at great risk in order to save this child.

Second the old crying wolf can come in and the next time a call come into a 911 center about a child or adult in harm-way in some odd manner this hoax could cause a slower response and lives could be lost.

I heard that they were considering lowering a weight from a chopper in order to bring the balloon down . They didnt do that because it WOULD jeopardize the chopper crew. Im not aware of any other tricks that were seriously considered.

IM having difficulty understanding you BUT, IF iM CLOSE LEMME KNOW. you say that because this episode will be considered as "crying Wolf", the next time critical help is needed, the rescue giuys wont come to the aid of those in distress. If thats your point,all I can say is "I hope not". We recently had about 10 false fire alarms being entered around here because we had a spate of barn burnings a few years ago and some kids were having fun setting out 911 calls that were phony. EVery call was responded to with huge masses of equipt because a barn fire can be very dangerous. The fire company and rescue squads didnt hold back on any call. However, the calls were all investigated.SInce our technology now allows us to id where a call comes from almost immediately, using any kind of phone is like putting a label on your home address or place of business if a fake call is made.(The kids involved were all rounded up and those over 18 were charged and names printed in the papers)

Also, remember the rescue guys are pros. They operate in a different mode where they are ,like greyhounds, they get going fast no matter about the veracity of the signal. They never question the 911 call, they just go.NOW, after it had been determined that it was a possible hoax The rescue guys and police will conduct in- depth investigations to get to the bottom . (I think, in this case, the cops had as much interest in clearing the air as they did in the original rescue attempts). Each attempt at 911 report is a learning opportunity, no matter if real or not. Im sure they will adjust their knowledge base for future "runaway balloon" rescues .

seems like the networks involved are taking care of things. Their wifeswap episode was delisted (it's still available on youtube) from an airing later this month, and apparently the family hasn't been taken up on any of their other planned programming.

The dad still has psyience detectives (2012 world ending gig) which has it's lovely moments. ha!

No they are not accused of faking anything, NO charges of any kind have been filed.

CNN) -- The wife of a Colorado father at the center of the "balloon boy" saga told authorities that the giant helium balloon was specifically created for a hoax to draw media attention, according to court documents released Friday.


The Heene family -- including Falcon, second from right -- on CNN's "Larry King Live" last week.

Mayumi Heene told Larimer County investigators that she and her husband, Richard Heene, knew that their 6-year-old son Falcon was hiding at their Fort Collins home the entire time, even as police and military scrambled to search for the boy, according to the documents.

The admission by Mayumi Heene was made October 17, just two days after the balloon was released, according to the documents.

The Heenes initially told authorities that they believed their child had flown away on the balloon, and when the balloon landed without him, they expressed concern that he may have fallen out of the device.

The couple hatched the plan about two weeks before the incident and "instructed their three children to lie to authorities as well as the media regarding this hoax," according to the documents.

Calls to David Lane, Richard Heene's attorney, and Lee Christian, Mayumi Heene's attorney, were not immediately returned Friday.

Richard and Mayumi Heene are each facing a number of local charges, including conspiracy, contributing to the delinquency of a minor and attempting to influence a public servant, Larimer County Sheriff Jim Alderden said Sunday.

Lane told CNN earlier that the sheriff was overreaching and that the family deserve the presumption of innocence.

The Federal Aviation Administration is also investigating the incident.

Richard and Mayumi Heene met in a Hollywood acting school and pursued fame for their family in the world of reality TV, Alderden has said.

The Heenes have appeared on the ABC program "Wife Swap." Richard Heene also chases storms, brings his family along and takes videos. TLC, which produces the show "Jon & Kate Plus 8," said the Heenes had "approached us months ago" about a possible show, "and we passed."

Colorado parents plead guilty in balloon boy saga

FORT COLLINS, Colo. " A Colorado couple who reported their son was aboard a runaway balloon could land in jail after pleading guilty Friday to charges they made up the story to generate publicity for a possible reality TV show.

Richard Heene appeared before a Larimer County District Court judge first, pleading guilty to a felony count of falsely influencing the sheriff who led the rescue effort during the 50-mile balloon chase that captivated a global television audience Oct. 15.

Mayumi Heene pleaded guilty to a misdemeanor charge of knowingly filing a false report with emergency services. Prosecutors said she had a lower level of culpability and cooperated with authorities, telling investigators the balloon launch was a publicity stunt two weeks in the making.

The Heenes are amateur storm chasers and had twice appeared on ABC's "Wife Swap." Richard Heene's business associates said he was trying to pitch a TV series based on science, and the couple had a tentative deal in the works with RDF USA, which produces "Wife Swap."

RDF has said it scrapped the plans after the balloon flight.

Even as the Heenes entered their guilty pleas, their attorneys' comments in court set off speculation of talk show appearances or other deals.

Judge Stephen Schapanski agreed to the attorneys' request that the couple be allowed to travel to New York and California to explore "employment opportunities." David Lane, Richard Heene's lawyer, declined to elaborate as he left the courtroom, and Heene waved off questions.

At least one New York-based production company ruled out a Heene venture.

"It's just too poisonous," said Irad Eyal, vice president of development at True Entertainment. "I don't think anyone is going to want to meet with a man who shamed his family and children that way. In reality TV, there's a definite line you don't cross, and that's tormenting children."

Lane said the couple would have no public comment at least until sentencing, set for Dec. 23.

Under terms of the plea agreements, Richard Heene faces up to 90 days in jail, probation and a fine. Mayumi Heene could get 60 days, likely to be served in a work-release program, and probation.

Richard Heene also could have to pay restitution for tens of thousands of dollars in costs incurred by police.

Without the deal, the charge against Richard Heene carries a possible sentence of two to six years in state prison and a fine of up to $500,000. The charge against his wife is punishable by up to six months in the county jail and a fine up to $750.

The deal does not call for removing 6-year-old Falcon or the couple's other two children " ages 8 and 10 " from the parents' custody, according to Lane.

Larimer County Sheriff Jim Alderden has said the Heenes deliberately released the balloon and falsely reported Falcon may have been inside. The boy was later found safe at the Heenes' home.

The story began to unravel when Falcon Heene said they "did it for the show" during a CNN appearance.

Investigators found evidence Oct. 17 that the Heenes were working with RDF on a reality show, according to court documents released Friday. It wasn't clear when RDF's plans were scrapped, or if the company knew anything about the couple's plan to release the balloon.

RDF didn't immediately respond Friday to phone and e-mail requests seeking comment.

Sheriff's spokeswoman Eloise Campanella said Friday some aspects of the case were still under investigation. She would not comment on RDF.

Lane portrayed his client's decision to enter a plea as a sacrifice to preserve the family and avoid the possibility that Mayumi Heene, a Japanese citizen, could be deported by being convicted of more serious charges.

Lane said prosecutors threatened Mayumi Heene with that prospect. But chief deputy district attorney Andrew Lewis insisted Friday prosecutors never did so.

Richard Heene was asked after the hearing if he had anything to say to those who looked for his son. He didn't respond.

I dont get it. Does Bill condone Kangaroo court justice? Lets sentence people before we even convict them?
We have a system of laws Billy. AS impatient as you are to hang the guy, we must first find him guilty or at least have him admit his guilt. It appears that he is ready to do that. Now there can be some sort of sentencing before judgement.

I hope you never run afoul of the law Billy. Too many "hang em high" proponents can really **** with your civil rights no?

Relax and just report the facts , we will make up our minds for ourselves. I for one dont need filtering of a news report by some vigilante.

If he pays full restitution,
then that appears to be a fair resolution to everything.
If he does THAT, then there is no reason for him to be incarcerated.
