i haven't read the whole read, though i skimmed through most...so apologies if this is repetitive.
If you have a boss that wrote you a letter and is threatening to fire you, you want to have a paper trail. i would put your complaints in writing (including selling stuff that's not for sale) and submit it to the boss (keep a copy for yourself!), and if there's someone supervising your boss, than to that person as well. Try to be diplomatic (you can still be assertive) -- it tends to get taken more seriously that way. And if you do get fired, you will have proof that you tried to improve the situation in the store.
I think that is what I would do. I know that is not the legal advice you were looking for, but it might be helpful in the process of firing or resigning if it goes that way.

I was beneficiary of this phenomenon recently. A friend had an advance reading copy of a cookbook I have been avid to read, from one of my favorite food writers. The friend sells a moderate amount of books on Amazon but assumed that would be a no-go there (and I also presume he's right, but don't know), where he has a tip top rating. So he mailed it to me since we both like that writer. Happy day, it's a keeper. But this is not my first time for seeing a book as Advance Copy etc. Am used to them in used book outlets.
