Although I agree with your statement,and I am against activist courts,and activist judges, sometimes arent the courts just used by the general public to solve problems that they dont want to deal with?Or,dont have the intelligence to find an alternative resolution?
Certainly you remember in the 80's and 90's when the courts were full of cases of alleged child abuse by a pissed spouse? A large percentage of those cases were falsely brought forth strictly for revenge. It wasnt until courts and the falsely accused fought back that it subsided.
Family court should be an option of last resort, unfortunately its usually the first option people choose.
