Wrong.
It's legal to give money to people to buy their silence or make them go away (which you admitted).
It's legal to authorize someone else to make the payment.
It's legal to reimburse them for the cost.
If you disagree, state the statute explicitly. The idea that it's legal to pay someone to go away but not to have an employee do it for you is laughable. Again, if you disagree, state the law explicitly.
As for writing it off as a business expense on your taxes, if he even did that, businesses probably write off money paid to protect the company's reputation all the time. At most, the IRS should have said, "We disagree with your interpretation. We disallow this deduction. Repay that money with a penalty."

It's not only Trump. Members of his administration have been questioned and arrested many times before. Most people will at some point make a deal to avoid being ruined financially.
