Per the Associated Press (and a buncha other sources), #45 has been indicted: https://apnews.com/article/trump-hush-money-new-york-indictment-election-027d0e5ac1881a4c55c6379deae75faa

Now, you may be wondering why this is a health spa.

It's because you and I both know that tempers will undoubtedly flare and people will say things that they should not.

Therefore, we are all going to sit in fluffy robes and get our temples massaged (not a euphemism) and mark this day, preferably without letting all hell break loose.

There will be a lot to discuss in the days ahead, no doubt. So make sure to make your appointment with Sven or Inge, and grab your beverage of choice. But not kombucha, 'cause that stuff skeers me.

Thank you for your anticipated cooperation.

Please don't steal the towels.

@jespah,
(Donning my fluffy robe)

I thought the real lesson from Watergate was that the coverup can be worse than the crime. Paying off Stormy Daniels for her story is not illegal. Writing that off as a business expense is fraud. This was so easy to avoid. For someone with so much money, the greed factor is insane.

@engineer,
Trump's defenders keep saying that the indictment is nothing more than politically-motivated persecution, while blindly ignoring the actual crime – politically-motivated deception by Trump and Cohen. Cohen was convicted and sentenced. Why should Trump be treated differently?

@hightor,

they are also screaming about "election interference at the highest level in history",
as if the indictment is somehow worse than an attack on the capitol...

@Region Philbis,
Which is an issue, also, because the indictment hasn't been unsealed yet. So, anyone complaining about such is, oh, I dunno, not caring what's actually in the indictment to begin with???

@jespah,
Can I get a day pass or is it cheaper to get a yearly membership? Is the spa dog friendly? Since I don't have a dog, then do the spa provide a dog?

@Brandon9000,
Ask the prosecutors, they might be able to put you in touch with someone who can put in terms you'd understand.

@Brandon9000,
Quote:
What specific crime are you suggesting here that Trump committed?

While it's apparently okay to funnel money to people to buy their silence, it's not okay to authorize someone else to make the payment, reimburse them for the cost, and then write it off as a "legal expense". The fact that Trump was running for office at the time and feared the repercussions of exposure strongly suggest a political motivation.

Quote:
Now, the important thing about that – because Trump and all these people are accusing the indictment tonight of being political. The U.S. Justice Department looked at precisely this set of circumstances: the payoffs to this person, the hush money, the like. And it concluded it was a federal crime, such a severe crime that it sent a person to jail, Michael Cohen, who was Trump’s lawyer.

And when the U.S. Justice Department sent Michael Cohen to jail, it said Cohen acted not on his own. It’s not like he came up with his plot on his own. It said that Cohen acted at the direction of Donald Trump, that Trump ordered him to do it.

Now, that was what they called a crime. The U.S. Justice Department then – and Cohen went to jail for – that was not the Merrick Garland Justice Department. It was not the Barack Obama Justice Department. It was the Donald Trump Justice Department that made that filing. So, every time you hear this thing about, “Oh, this hush money thing is political” and the like, remember it was Trump’s own Justice Department that called this crime back in 2018.

@Brandon9000,
Trump is accused of fraud, of listing fake expenses on his business dealings to avoid taxes.

@hightor,
Wrong.

It's legal to give money to people to buy their silence or make them go away (which you admitted).

It's legal to authorize someone else to make the payment.

It's legal to reimburse them for the cost.

If you disagree, state the statute explicitly. The idea that it's legal to pay someone to go away but not to have an employee do it for you is laughable. Again, if you disagree, state the law explicitly.

As for writing it off as a business expense on your taxes, if he even did that, businesses probably write off money paid to protect the company's reputation all the time. At most, the IRS should have said, "We disagree with your interpretation. We disallow this deduction. Repay that money with a penalty."

The Democrats have tried accusation after accusation for years to try to pin something on Trump. This is just the first one that got this far. This is clearly a case of, "Let's find a crime for this man."

Countries in which the party in power makes up any flimsy BS they can find to throw the leader of the other party in jail are called dictatorships or banana republics. Thanks for reducing the US to that level.

It's not only Trump. Members of his administration have been questioned and arrested many times before. Most people will at some point make a deal to avoid being ruined financially. Thanks to you, from now on, members of the party out of power, whichever one it is, can expect to have people poring over their lives looking for a defect and to eventually go to jail. Thanks for reducing the US to that level.

@Brandon9000,
Tell the prosecutors Mr Legal expert.

You keep setting little rules for everyone else while being incapable of answering the most basic questions.

You have no credibility, you lost years ago.

@Brandon9000,
You state the statute.

You're always trying to get others to do your homework for you because the lack the wherewithal to find it yourself.

I'm sure that if Trump is sentenced to life imprisonment he'll be happy as long as Brandon thinks he won his argument here which is all that matters.

I mean who really cares what courts decide?

I was simply putting the action in context; I wasn't implying that there was a specific crime in having someone else pay hush money – the problem was Trump's trying to foist it off as a legitimate payment for "legal services".

Actually, falsifying business records is a very commonly prosecuted crime in the Southern District of NY:

Quote:
A core crime that the Manhattan District Attorney will likely include in an indictment of former President Donald Trump is “falsifying business records in the first degree,” a felony under New York State law (N.Y. Penal Code § 175.10). Prosecutors and indeed all of us are compelled by the rule of law to consider how such a charge compares to past prosecutions. Are like cases being treated alike?

Here it appears they are. Prosecution of falsifying business records in the first degree is commonplace and has been used by New York district attorneys’ offices to hold to account a breadth of criminal behavior from the more petty and simple to the more serious and highly organized. We reach this conclusion after surveying the past decade and a half of criminal cases across all the New York district attorneys’ offices.
