Such a challenge would have been pointless, as federal election law said very clearly that the final recount tally must be accepted if the recount was completed by December 12.
The Supreme Court saw to it that the recount was completed by December 12.
Al Gore could have made the challenge certainly. But he would have quickly lost while achieving nothing.
Such a challenge would have been pointless even without the Supreme Court, as the official state-certified results could only have been overturned by a vote of both the House and Senate, and the Republican House would never have done such a thing.
So really all the Supreme Court did was prevent Al Gore from causing a pointless crisis.
