i cant remember who it was but not so many years ago a famous jurist commented that it is not unusual for the jury to find that the defendant commited the crime charged but delcined to convict. this was regarding Dr. Kavorkian (sp) and was regarded at the time a legally correct verdict.

I did not understand what you meant by nullification. I am sure the defendant will ask for a retrial, however, whether it will be granted or not is questionable. I should note that I have no experience with courts and know very little about rules of evidence. It is just that I was struck by what it seems to me to be a miscarriage of justice. Maybe not law but justice. I sometimes get the feeling that the two are mutually exclusive.
