Hi,
My girlfriend has a 4 year old son. The father and his parents borrowed their daughter from her and did not return her daughter. Now the father is threatening my girlfriend that he will not show her their daughter unless she comes back to her. They are not married. What can my girlfriend do legally?
@sam7410,
Has she contacted the police? does she already have a lawyer dealing with custody matters?
@sam7410,
She has a son and a daughter and the father only took the daughter?
@ehBeth,
Hi there, they only have a daughter. No police or anything. No lawyer yet. Basically after what happened there was no actions. I believe there are times that they let her see their daughter. But now he threatens not to show their daughter unless she comes back to him.
Is this in the USA?
If so, he MAY be guilty of kidnapping - if the mother had initial custody. Parents can NOT be prevented from visitation with their own children UNLESS they are deemed not fit by a court.
@sam7410,
I would talk to a lawyer right away. You could go straight to the police, but a lawyer is probably the best way to know all of your options and figure out the correct legal strategy.
I have a feeling this is NOT in the US. and the OP is a student of English.
Lawyer. NOW.
Get off the Internet and have your girlfriend consult a lawyer.
Thank you for all your responses. Much appreciated. No, I'm not form the U.S. I'm from the Philippines. I pretty much have an idea, I just want to hear others take on this matter.
It is unfair and cruel to use the child as bait to get the woman to come back to the man.
She should consult whatever is Family Court to get visitation.
If there are problems between the parents, the child could be taken to another place and the mother picks it up there. (this is often done in the US. Sometimes police departments are used for handing off children from one parent to another.)
