I don't know the law in this regard. I do know that I had the impression that she won on the basis of her claim that he had verbally promised her money.

Hmmmm - somewhat of a toughie.

I don't think people ought to get money just for marrying someone.

By the same token, I would have thought the nature of the transaction was clear to both parties, and I think one honours one's agreements, dead or alive.

It is quite clear, as Sozobe and Dlowan have both pointed out, that this is a T&A thread. It was a feeble attempt on the part of kickycan to try to sneak this one by us.

Go to 2-105 No Taker. Just below that is "Intestate share to surviving spouse". That's the rules for when there is no will or the will is declared invalid. When there's a will, see Figure 4-1 A Decedent's Property Interests.

Here's another site re the Uniform Code, specifically relating to California: http://www.thelawshack.com/UPC.html I'm not sure about ANS's case, but if she and JHM held their property as community property with right of survivorship, that property would not go through probate and therefore would not be a part of the estate at all, so far as I can tell.
