PERVERSION of the Justice System in NYC
It is fundmental to American justice that a man
has the right to be confronted by his accusers
not only in criminal cases, buy in all litigation
because each side is rightfully entitled to a fair trial.
"No State shall make or enforce any law which shall abridge
the privileges or immunities of citizens of the United States;
nor shall any State deprive any person of life, liberty, or property,
without due process of law; . . ." 14th Amendment, US Constitution.
The NYC Taxi & Limosine Commission has enacted new rules
for processing complaints against cab and limosine drivers,
by whose terms, complaining passengers need only CALL IN,
by telefone conference call, to express their complaints
against the drivers. That is very unfair to the defendant drivers.
An essential element of a judge 's job is to assess the credibility
of witnesses, including the litigants. This can be difficult enuf
to do when u see them in front of u and their testimony
is factually contradictory. It is unreasonable for a judge
to do this over the fone. It degrades the process of litigation
and it degrades the quality of resulting justice for the litigants.
I take a lot of cabs and limosines in NY.
Almost all of those rides have been uneventful.
Very, very seldom have I had any trouble with a cab driver.
I have never even thawt of driving a cab,
but this new rule shoud be deemed offensive
to the US Constitution, for its basic unfairness.
This is not to imply that the same thing has not already been done
elsewhere, but that does not make it right; its just expedient.
