A criminal attempted to break into a house in Mountain Home, Ark. 
by throwing a concrete block through the window of a door that led 
into the bedroom of the homeowner's four-year-old daughter. 
The homeowner became aware of the intrusion, retrieved a .22-caliber revolver 
and shot the criminal in the head and abdomen, ending the home invasion. 
The intruder was taken to a local hospital where he was listed in critical condition.
The Baxter County Sheriff's Office and 14th Judicial District Prosecutor 
Ron Kincade have noted that they will not pursue charges against the home owner.

How do we know the man wasn't throwing that concrete block at something else, and it accidently went through the window?
