Judge Rules Gay League Can Limit Number of Heterosexual Players

A federal judge ruled Thursday that a gay softball league can limit the number of heterosexuals on its teams, the Courthouse News Service reports.

The ruling was announced after three bisexual men claimed they were kicked out of the Gay Softball World Series for not being gay enough and filed a lawsuit in Washington state against the North American Gay Amateur Athletic Association.

The three men, playing for a San Francisco softball team, were challenged on their sexuality by a rival team, citing a rule that limits no more than two heterosexuals on a team.

The men claim they were "summoned to a hearing room to answer questions about their sexual interests or attractions," according to the Courthouse News Service.

The men said they were told that "this is the Gay World Series, not the Bisexual World Series."

U.S. District Court Judge John Coughenour struck down the lawsuit.

"Plaintiffs have failed to argue that there is a compelling state interest in allowing heterosexuals to play gay softball," Coughenour wrote, according to the Courthouse News Service.

"It is not the role of the courts to scrutinize the content of an organization's chosen expression."

The judge did rule the association failed to prove it should not be subjected to public-accommodation laws.

A trial date has been set for Aug. 1.

Seriously, I didn't post the OP. I don't search the Internet for such stories, because I have no interest in them. I knew that gays participated in sports (including football) just like every other group of people, but I didn't know there were any gay and bisexual sports teams. Perhaps Renaldo didn't search the Internet for any stories about them, but just happened to randomly come across a mention of this team and the attendant controversy at a conservative website and went on from there. Smile

If I understood the original posted story to this thread, the gays were just being "conservative," in that they wanted to associate with only other gays. Isn't that the basis of conservative thought? To have the right to associate with whom one wants? The ruling seems to reflect conservative thought? Call it a "restricted ball club." No different than the "restricted clubs" that were allowed to not have Jews or Blacks. I see no liberalism in this story?

You didn't understand the original story to this thread. You will have to establish that the gays who complained are political conservatives. I don't think you can do that. Go for it.

"Conservative" is not just political, it is also social. A socially conservative person oftentimes only wants to socialize with one's perceived peers. Social liberals more often find it acceptable to socialize with a diverse group of people.

It is a non-sequitor to make political conservatism the criterion for the concern of the gay ball club to be acting conservative. The club is acting as social conservatives.
