The justices are people of their time and don't live in a vacuum (as hard as Scalia and Thomas have tried to).
Thomas and Scalia are trying to do the job the way it was intended to be done. You don't see that because doing so doesn't achieve your desired results.

I find it funny that the last thing written in this discussion was an agreement to try to be civil, and that seems to have driven everyone off!
