OK: WHAT'S NEXT, THAT WE DON'T KNOW ABOUT, JURISPRUDENTIALLY ?

( or Evolution Toward Where We Were In The First Place )


We already know, from reading HELLER itself
that the USSC will apply the reach of the 2nd Amendment
nationwide and thru out the streets of America,
not confine the right of selfdefense to our bedrooms and bathrooms,
so what 's the next big question, defensewise?

In my opinion:
it is government discrimination as to the right of selfdefense.

. . . . . . . . . . . SAINTS and ANGELS Doctrine

The Bill of Rights was NOT enacted for the sole protection of SAINTS and ANGELS:
it was enacted to protect the liberty of ALL American citizens.


Even if Leona Helmsley or if Martha Stewart were armed with a revolver or a pistol
on venturing forth to buy a gallon of milk, or even just keeping
an anti-rape gun in her bedroom, that woud have been a federal felony,
because thay were both adjudicated criminals.

Once the principles of the 2nd Amendment are fully deployed nationwide,
will the USSC declare that government has jurisdiction
to tell any citizen that:
"u cannot defend your life, nor your little child 's life,
nor rescue your mom from getting gang raped, because u stole a car when u were 14,
or because we caught u smoking a joint when u were in college " ?

An affirmative response woud "shock the conscience"
as Justice Felix Frankfurter put it in ROCHIN v. CALIFORNIA,
342 U.S. 165, 72 S. Ct. 205, 96 L. Ed. 183 (1952).

Therefore, in my opinion, if the current 5 liberty-oriented Justices remain dominant
on the USSC, personal liberty will march on in the fullness of glory,
as intended by its Constitutional Authors.

As I have posted many times,
government shoud physically prevent violently recidivistic felons
from having access to the decent people, by ISOLATING
those criminals, or by BANISHING them from the North American Continent.

Guns shoud not be blamed for crime, as spoons shoud not be blamed for obesity,
nor shoud pens be blamed for forgery.
