if a drive was formatted can we get the data back?

Yes. (I don't know how). I believe that generally, formatting doesn't wipe the data from the drive, just the pointers that point to the data. That's why the military uses programs that wipe, optimise, wipe etc something like 7 times, to make sure the data is actually gone.
