Just talked to her again, it is temp. custody... she is going to see the baby today

It appears that unwed mother was living with unwed father and having an affair on the side with military boyfriend.

Military boyfriend gets re-stationed at an out-of-state base. Unwed mother and military boyfriend decide to get married so she can go with him. I'm speculating, but it appears that unwed mother and military boyfriend may have been planning to slip out of state with baby and without informing unwed father.

Unwed father learns of the plan or is told at the last minute and races to see a lawyer. Unwed father files custody petition and makes emergency motion to be awarded temporary (interim) custody of the baby while custody action is pending. Grounds for emergency motion (speculating) are that unwed mother was planning to flee the state with baby and military boyfriend without first obtaining a permanent custody determination and that the best interests of child required that the baby remain in his usual and customary home with unwed father in the child's "home state" until a full evidentiary custody hearing can be held and permanent custody determined.

Given the fact that unwed mother was planning to leave the state with the child and planning to do so without a court order granting her physical custody--the unwed mother has demonstrated disregard for unwed father's parental rights. She also appears impetuous and perhaps unstable given the quicky marriage and suddenness of her planned move. She appears to be placing her own selfish and impulsive needs and wants ahead of the child's best interests. Accordingly, it would probably be unwise to allow her to leave the state with the baby until the entire matter can be heard at a full evidentiary hearing.

Under the circumstances, the Court granted temporary custody to unwed father. Unwed father is remaining in the family home, he has a stable work history, and he is able to afford day care expenses for the child while he works. The baby can continue to spend his evenings and weekends with his father and sleep in his own bed.

While unwed mother is out of state--setting up her new home and enjoying honeymoon bliss (or maybe not)--unwed father will be establishing continuity and stability with the child. If the child thrives in unwed father's care, the court probably won't find much benefit in altering the custody arrangement that is presently in place. Accordingly, if all goes well during the interim, unwed father will most likely win permanent physical custody with unwed mother awarded reasonable visitation privileges and ordered to pay child support.

Unwed mother is young and in love, but there are consequences. Her impetuous conduct has more than likely cost her the custody of her child.

Well Debra basically sums it all up... Except the military boyfriend just flew in from Washington to get her. He was never in the state with her, they met when she went on a trip.

As they say in Minnesota, UFF DAH.

Do you know much about this man who flew into the state to get her? The whole situation sounds NUTTY and I'm so glad the unwed father stepped up to the plate to protect the child from the folly of unwed mother's lack of good judgment.
