you see im into hiphop production/rapping, and me and my cousin were gonna do a "mixtape" and sell it all around our city to raise funds for new equipment and such. basically a "mix tape" is when you take instrumentals from other artists cd's and rap over it to get a new song with an old beat. so its gonna be OUR words but with sombody elses beat., now.....ive heard that this is totally legal to sell only as long as its labeld a mix tape. does anybody know if this is true? what if we gave credit to the producers of the beat (but no money) on the cover of the cd?

drift: If you use someone else's copyrighted work, you must get their permission/pay royalties: simple as that. There are a few exceptions (fair use, for instance), but none of them apply to your case.

To give one example: Michael Jackson used about a minute of a Cleveland Symphony Orchestra recording of Beethoven's Ninth Symphony in his song "Will You Be There?" and was sued by the orchestra for copyright infringement.

Check out this site for more information. Although it is focused on the British copyright system, it has some general information about issues involving sampling and copyrights.
